My apartment just flooded. can i break the lease agreement now?
I just moved in and the apartment first had rats, then it flooded. Would I be able to break the lease agreement and move out and would i be able to make the landlord pay for damages and do I have to pay the rent for this month? Who do i need to call to inspect this place? PLEASE HELP IM DESPERATE. There is water everywhere and bugs and probably mold growing. Everythign is still wet.

it flooded because there was a pump that was malfunctioning (im not supposed to touch it) and the door area is baraccaded by walls so water just collects in the area and the pump is supposed to pump it out.

I kinda think you may have to give the landlord a chance to fix the problem, but this seems so bad that maybe not. I'd check the phone book for your county and look for something like "Landlord Tenant Relations". Call them up tomorrow and ask them about this. If the place is unlivable and it sounds like it will remain unlivable for awhile then you should be able to move, but I'd check with them.
About your stuff, the landlord probably won't be responsible unless you can prove he was negligent. Its annoying, but it really does not sound like negligence, but rather than something just broke (it was out of his control). So you may be on the hook for your damages. You may want to consider getting renters insurance in the future, as this is the sort of thing it covers. |

damages to your things has to go under you're insurance that i'm assuming you have... or possibly your landlords insurance. you are able to break the lease if the landlord doesnt do anything about it, and if it puts you at risk or in danger he has to find you an alternative place to live as you ageed to living conditions in the lease. |

I would call the department of safe housing first thing in the morning, tell you the truth, I would check in a motel tonight, deduct it out of any kind of rent, and call the housing department in the morning, they will tell you what your state laws are, but I honestly believe you should be able to get out of your lease, and yes you can sue the landlord for any kind of damages especially since it sounds like he's breaking some safe housing laws with having thing barricaded, honestly it sounds shady, look in the gov. pages in the phone book and contact an attorney, he sounds like a slumlord and judges will eat them alive, good luck, I've been there. |

I understand that you're desperate, but the first advice for you is to make sure that you do not have any kind of altercation with your landlord; believe me, you want to be able to have a normal, calm relationship so that they are more willing to wanting to help you come up with a solution to the situation.
Anyway, if you don't have an attorney, you may be able to call your local police department and ask for advice as to what you should do. In any case, make sure that you write down all the damages that have been created due to the flooding.
About paying for your rent, try to talk to your landlord right away, so that you get a better idea of what their approach is to this issue (hopefully positive) that way, you'll feel a lot better to know that you are paying rent as you are expected to and that, in return, you are getting what you were promised when you signed your lease.
Hopefully things will turn out well and, assuming that your landlord has property insurance, your things will be replaced; in the mean time, you need to be moved to another unit for safety reasons of course.

had a big mold problem in my apartment. I called the housing inspector for the city. Look up your city housing inspector and have them come over and look at the place. I found them on my city's website also should be in the phone book. Leases suck to get out of- as long as the problem is seen as fixable the landlord will probably not break it. But- the inspector will make sure the job is done right and will make your landlord start fixing it. The inspector however can only help get things fixed and not help you get out of the lease because their only job is to make sure the housing is good to live in. But im pretty sure- you may want to ask the inspector who to contact- but you can somehow get out of the lease if they fail to completely fix the problem within 30 days. Make sure you take pictures. your stuff may or may not be covered by the landlords insurance. When i got some of my stuff damaged mine said i could claim it to the apartments insurance but it was just a bookshelf so i didnt. I was able to cut my losses- get out of the lease because my apartment was deemed uninhabitable and i ran like hell! So- first step- call housing inspector- mine was a great help with my situation. (of course call maintenance if u havnt). |

Sounds like you don't have to...they already did by not providing adequate living conditions. You may be entitled to compensation for damaged property. Go get em but be wary of leeching lawyers. You can do it yourself. Take pics of everything and have witnesses. Hopefully you have pics from before the flood too but it's not really necessary.
And Bertie is right, they have to provide adequate shelter for you in the meantime, but first you have to give them a reasonable amount of time to correct the problem. If they don't, file a lawsuit in small claims if damages are not extreme. |
