Apartment maintenance problems...what can I do???
Ok, so for the last 4 to 5 months our air conditioner has not been cooling properly. The maintenance guy came and attempted to fix it but couldn't figure it out. He then promised to order a new unit. Well it came in like 3 1/2 months ago, yet he is too busy to install it. Now he claims he has a back injury. Ughh, Our electric bill was around 180 a month for a small 2 bed apartment. Then the last 3 bills have been 280, 325, and then 280. We should be getting another bill anytime now!! What should I do. Can I make the apartments reinburse me for the excessive electric bill?? I should not have had to pay those outrageous bills, but I had no choice, I couldn't let them turn off my lights. I have called maintenance twice a week since the problem started! Please help me, and let me know what my rights are. Thanks

You need to stop paying rent. Put the money aside in a separate checking or savings account (to prove that you have intentions to pay), and notify the landlord that until your new unit is installed, you will not be paying rent. Furthermore, you will deduct any amount over $180 from your rent, in order to cover the electric bill.

Send this in a certified letter.

Talk to the owner to find another company who can preform a better job if not tell him/her that you can't continue living in this condition otherwise you will get someone else and bill the owner. See what will happen?? This bills are outrages!!

Stop being mr (or miss) nice guy/gal. Tell the apartment maintenance you are not paying any more rent until the problem is fixed and if it isn't fixed with a few days yor are suing them for the extra you have had to pay. You will be amazed how quickly they get it fixed (if not go ahead and start the lawsuit and stop paying rent). Once they do fix the problem I'd go ahead and send them all their rent - I think you could sue them for the extra costs but not worth it and will promote future ill will.

Let me put a different question to you. Why should they fix your air connditioner as things are now since you have proven perfectly willing to continue paying them and live with the problem for months.

It isn't always easy to get things done, but you can certainly get what you deserve in the end. Here's how: Put everything in writing. No more phone calls; write letters and give them to the managers in person. Make and keep copies of their responses to you. Make and keep copies of your bills. Pull out your lease contract and see what it has to say about maintenance so that you know what they are contracted to do for you. If they are contracted to provide air conditioning then you can threaten to sue them. Good luck.

Contact your landlord let him know that the apartment is becoming unlivable,
and you really need the unit installed ASAP.
Hopefully he is compassionate and will find someone to put it in since his maintenance man is down in the back.
as for the bills sorry you'll have to eat them,
as soon as you knew it wasn't running right 4 - 5 months ago you should have shut it off, that is why your bill got so high it isn't their fault you left it running.

Time to move out and find a better place to live. Talk to the manager. Plead insanity and file letters of incorporation.

First of all you can go to small claims court and if you do not want to go that route try sending a certified letter to management. I am not sure what state you live in but go to findlaw.com or nolo.com and read up on your rights so your letter looks like you know your stuff. I would try the scare tactic first. Include a copy of your lease or rental agreement with the maintenence claus ein it stating you are covered. Good luck and fight for your rights.

No they won't pay you back for the electric bill. Tell them that you are going to get someone in and fix/replace A/C and take it off your rent.

So are you saying that your air conditioner not cooling properly is a result of your electric bills being sky high? If you noticed this the first month, why did you use it for the next 3 months? If your name is on the bill, you are responsible. If you take it to court, you will have to prove that the AC not being repaired by the landlord was a direct result of your bills and then the judge will ask you why you continued to use a broken air conditioner if you suspected it was not working well and it was the cause of your high bills. Your bill depends on your usage. If you are disciplined, your bills should not be high. Afterall, you did not have to use the AC. Should it have been repaired if it came with the apartment yes. Does it make your apartment unsafe and inhabitable by it not being fixed no. You could shut it off.
