Apt rental agreement question with a faulty appliance?
I have just gotten a new 1-bedroom apt and it came with a refrigerator. most of the apts though in this bldg and managment company DO NOT come with a refrigerator and so i noticed there was one when i saw the apt. so since it looked newer, i gave away my old refrigerator which was old but worked fine. well now this current refrigerator doesn't work well and sometimes is not cold and it goes on/off cold. my milk spoiled. my question is does the management get this fixed for me or do i have to fix it? i have a feeling they are not going to fix it since the other units do not include refrigerators. at least if i fix it i should now "own" this refrigerator correct? i'm in california btw...

i talked to the manager and she said that since it was there as a "bonus" or "convenience" that it isn't their responsiblity which doesn't seem right to me. if i'm gonna have to fix it i'm definitely going to have them sign an addendum though to state that it is my refrigerator.

Check the rental agreement, or the walk through checklist that you did before you moved in. If it said the refigerator was included by them, then they must fix it. But if they make you responsible for it them have them sign an adendum stating that if you are responsible for fixing it then it is yours to keep.

Your lease should tell you what appliances are included and who is responsible for their repair. And no...if you repair the fridge yourself...you are not automatically it's owner.

If they supplied the fridge then they must fix it...read your rental aggreement though, they may have some loophole where it is your responsibility...

in california there are laws for that, you need to read the lease and see if it states that it includes the refrigerator and also ask management their, via certified mail about your concern send them a letter stating that the refrigerator that was INCLUDED in the unit is faulty and does not work and you need a immediate response as to whom the refrigerator belongs to, (you or them) and what exactly they will pay for for the repair, DO NOT throw it out as if it is in your lease they can charge you to replace it

You took over someone else's junk. I would buy a new one and get rid of that one....you shouldn't of got rid of yours! Although, If the landlords keep it there he is resp. to fix it.

It doesn't matter what they do in their other apartments.

First of all, on the lease, does it state that the rental company is providing you with a fridge? If yes, then they are obligated to fix it. If not, what happened is the former tentant left it and rental company has nothing to do with it.

If the place you are renting was supplied with a refrigerator then it is there responsibility to fix it.

Have you asked the management? Go over your lease agreement -- maybe there is a clause about appliances detailing whether or not the apartment complex is responsible for any repairs. There also may be some state law related to such matters.

Boy, do I feel backwards -- I've never seen an apartment that didn't have a refrigerator!

Check the lease, see what items it lists the landlord is responsible for.

If it was there as part of the apartment when you rented it, I would tell the landlord to fix or replace it.

If they won't do that, then tell them they need to lower the rent if there is no refrigerator.
