Are loud neighbors grounds for breaking an apartment lease?

I'm not sure about this legal part of the question. But it would make sense to me that if the management does nothing about it, and you can prove you made attempts in contacting management about the situation, you should be able to end your lease.

I believe so. Draft a letter that details how you have complained to them many times, and how they are unwilling or unable to solve the problem.

Then describe how detrimental it is to live with this noise. For example, unable to sleep / affecting your work, unable to read in evenings, keeping kids awake, can't hear your TV over the commotion.

Give 30 days notice if you can take it that long. If not tell them how you can't take it one more night wthout losing your sanity, and go.

yes. look at the contract lease with ur landlord. there must be a stipulation there saying anything in connection to ur problem.

hell, night is for sleeping and not for being awake listening to a band practice their crap.

that'd be pretty hard to make a good case that your neighbors' band practice violates your implied warranty of habitability in your apartment. Call the policy & report a disturbance of the peace (noise violation).

I'm not a lawyer, but it seems as though you'd have a good case. What a hassle it would be though. I'd talk to the management/landlord and suggest that if the situation doesn't improve, you will forced to move. This will motivate them to resolve the issue. Believe me, the management would much rather evict the loud obnoxious tenant, than risk losing the quiet one. Especially if the situation is liable to repeat itself. Good luck!

READ and UNDERSTAND your contract (lease)

if it is a legal contract for your state, county, city, it will be binding. renters rights differ from place to place and are changing, always.

I manage rental property and advise all who have a complaint about a neighbor to leave me a note, in their own words, the usual who, what, when, where. It is easier for me to take corrective measures if complaints are documented. police reports describing "disturbing the peace" are all helpful. It makes these decisions "no brainers".

as for your situation, document everything in detail. send copies of your complaints, include police reports to your landlord/property manager.

if after a reasonable time has elapsed and the situation has not been resolved then all that documentation will help your case. find yourself a lawyer, your adversary will have one for sure.

You may...BUT....only after giving the Landlord/management company WRITTEN notice and time to attempt to fix the problem...They may evict the offending tenant....If they fail to act then you will have recourse....But as I always say check with a lawyer to determine your full rights

My neighbors used to play loud music and wake up my four kids, i call the police about more than 10x and it still didn't do no good, so i went to my landlord and she said the only way we could get them out is go to City Hall and press charges, that will get them out. Yesterday my 5mth. baby was sleeping he turned the radio sky high(he has club speakers). I banged on the door so hard and loud, because i was pist, he haven't turned it up yet. Maybe you just need to put your foot down even though you don't want to, you deserve to live there just like them. Good Luck too!!
