i would think that yes, without a lease the person has no legal reason to be there. even with the lease , there is a question if the person lessor has the right to sublet / sublease to you . technically anyone living full time in an apartment needs to be listed on the lease.

do you have receipts to show you have been paying rent to this person ? i would just find a new place to live. why live where you are not wanted / have such stress ?

you might consider small claims court / but i would consult an atty for an opinion if your claim is worthwhile before you spend the money for filing fee. in pro se court / small claims court you can sue the other party / you do not need an attorney. it's about 100.00 to file / have the other person served a notice by a process server / you also have to send the copy to them by us certified mail return receipt. before you spend the money , i would make sure you can prove you had some kind of sublease / proof of payment etc. keep in mind that it can take one or two court days for you to attend which keeps you from working / making money. AND EVEN IF YOU WIN, this DOES NOT mean that you will get your money refunded. Getting your money requires a whole new court case / filing fee ... if they do not have any assets or wages to garnish you will not get much and this requires return court visits time.

sometimes, it's best to just move on ... get on with your life.

If Im understanding correctly (and it is hard to understand based on the way your wrote it).. You are asking if other tenants can kick you out? The landlord is the only person who can kick you out of your home. Unless you are talking about roomates? Sorry, you really do need to provide a more concise question or some other details.

no. legally they are required to give notice...if you are living there...they can call the cops on you..and th cops will tell you the same thing..they cant just kick you out...they have to give you notice.

No.If you are the tenant of record and your roommate is not, and you would like your roommate to leave, and your roommate has been in the apartment for more than 30 days, and your roommate refuses to leave voluntarily, then, unfortunately, you have only one recourse -- a formal eviction proceeding.

update - contrary to popular belief there are two types of roommates: a roommate might be either a joint tenant or a subtenant, depending upon the terms of the lease or rental agreement. when all the roommates are listed on the lease, each one can be responsible for the full amount of the rent due to the landlord (although it is possible that a special lease could be negotiated whereby each roommate is responsible only for his/her "portion" of the rent). where the roommate is not named and has not signed the lease, the roommate pays his/her portion of the rent to the named tenant, who has signed the lease, and the tenant is responsible for the full amount of the rent to the landlord.


now, the real question is if you and your fellow roommates (since some are not listed on the lease) are breaking your lease agreement by having too many roommates if your lease specifically states the number of people that may live in that residence. if this is the case, ALL of you may face eviction

not you nor your fellow tennants may force a roommate out of the residence without good cause.
