Are private tenants now allowed pets?
My Economics lecturer told us in class that they are bringing in new laws saying that landlords can no longer state that they don't want DSS, smokers or pets in their property. I have been living in my flat for four years and my boyfriend and I are DESPERATE for a puppy. However, I can't find anything online about this. I doubt that you will find anything about this on line. It's an area of law that I follow very closely and something of this type would need legislation to bring into place. There is nothing currently announced that would make such a change.

Even if something did happen, it would only apply to tenancies that started AFTER the law came into being. Until then, the landlord can set whatever legitimate rules are felt appropriate - and the ones you mention are all legitimate.

If you are really desperate to do something that your current tenancy agreement does not allow, you need to discuss this with your landlord to see if (s)he is prepared to agree a specific variation of individual terms, but be warned, the landlord may ask for other conditions to be included as well.

As a LL, I have a right to NOT rent to smokers and tenants with pets. I can and do discriminate, as long as it is not a prohibited basis like sex, race, religion. I don't want irresponsible pet owners in my property--read today's posting by tenant whose puppy got heartworm--or smokers--smelling up my property.

If you already signed a tenancy agreement stating that there are no pets allowed them you must stick with that.

It's up to the individual landlords because a girl in my building has hamsters but the landlord said that she could have them as long as their manager doesn't find out and she makes sure that they don't damage anything by scratching or chewing at any of the carpets or furniture. It does state in the contract that we are not allowed to have pets.

The rule with pets/smokers/DSS is up to the landlord, its his property and his choice, and if you don't like it then rent elsewhere.
I think your lecturer was talking out his a..e.

The chances of laws requiring landlords to accept pets are nil. Dogs can cause damage to a landlord's property and a fundamental right under the law is to protect your property.

As far as smokers, same thing but in some areas there are regulations that appear to allow it. The difference in those areas is landords can ban smoking but they can't ban smokers. The difference may seem petty but what it boils down to is, landlords can't discriminate against people but they can discriminate against behavior that may result in harm to the property. It would be easy to see how someone, such as your lecturer, could get confused about this.

Im not sure if its true or not as I have heard nothing. But either if its true or not. Your current contract is signed and you have to abide by that even if new rules come into effect.
