Nope, if you broke the lease and left owing money then the landlord has the right to apply the deposit towards unpaid rent, and still come after you for the balance owed if stated in the lease. chances are they will send you to collections and if not collected file a lien against your credit in order to collect.

You'll be lucky to not be sued for their losses, if the suite went unrented for more than one month = damage deposit amount.

if all you lose is the deposit, consider yourself lucky. think of it from the landlord's point of view. now he has to unexpectedly put someone else in a vacant apartment to help defray his expenses. the tenant should lose their security deposit as they are in breach of contract (the lease).

Read your lease and you will find an answer to your question. Normally, you will forfeit your security deposit for breaking a lease for the months the unit is not occupied. IF your lucky.

While other landlords keep the full security deposit for breaking the lease.

READ the lease.
Tenants are breaking the lease, and it generally sets forth penalties and fees to tenants for breaking the lease. You do have to give them written notice within 30 days that you are retaining the deposit due to their breach of the lease and reletting charges.

You don't give enough details. Did they bail without warning or notice? What was the agreement. When you answer this a proper answer can be given.

If they have paid their rent until the lease expires or a new tenant was found and there were no damages to the unit upon moving out (I hope you did a move out inspection with them), then in most cases- yes. You'll have to check the landlord - tenant code where you are, though.

Not only do they forfit their deposit, the landlord can sue for the balance of the lease or for the time the apartment remained vacant.
