Are tenants in apartment buildings obliged to pay for landords repairs to the building?
i live in a regular 50-tenant apartment building. it is not a co-op - tenants do not buy their apartments nor do we have a share in the building ownership -- yet last year the landlord repaired our elevator and put in new mailboxes and made the tenants pay for all of this - he then fixed the roof and again sent us a paper from the housing department that we again are going to foot the bill for this - i have lived in apt buildings a long time and never had to pay for these major repairs - is this legal? can we, the tenants, fight this? do we have a chance of winning? i have never heard anyone else from other buildings say anything like this that they had to pay for building repairs - i don't believe this is legal but do not know how to go about finding the best lawyer in this type of complaint to help us fight it. any suggestions about where to begin? thank you.

no the landlord cannot bill the tenants for any form of general repairs unless he can prove it was the tenants that caused the damage or faults,if i were you i would go to citizens advice and ask for their help as they have their own solicitors that deal with this every day and take any letters from your landlord with you

First thing you should do is make sure you read the lease real good. Most leases specifies what the tenant and owner is responsible for. I have also never heard of tenants paying for roofs, elevators and new mailboxes, I mean isn't that what the rent is for right? I would check to see what the local housing rules are for your city/state where you live in. You could probably find that info in your phonebook. For some reason I find it hard to believe that it is legal what they are doing. Do the other tenants say anything about this? Because if the landlord been doing this for years, they are probably going to try to find a way to get rid of you for stirring up trouble, so be careful about how you go about this. I live in a huge apartment complex myself and I would be very mad if the landlord sent me a bill on a new roof. If you are like me, my money is already tight and so that would be an unexpected expense that I had not counted on paying for. You might also want to talk to your local Legal Aid who might can give you advice and more info on how to deal with the situation. Good Luck to you!

I have never heard of a landlord doing this. Repairs on the building is the landlords responsibility to insure your dwelling is safe. They can however raise the rent periodically to cover higher taxes or the cost of repairs. They need to be careful with this as it may be harder to find tenants. Unless the lease you signed stated that you would be responsible for building repairs I would not pay them. Most leases state the rent amount that you are responsible for and nothing else. If the landlord then tries to evict you then I would call a lawyer.

It would be, if you damaged something, and then he had to fix it.
Call the local housing council, any papers you have that can PROVE he's charged you, those hang onto. You'll need them.

Repair and Deduct
Your tenant may validly make repairs him/herself and deduct from future rent if:

-The Board of Health certifies that there are violations present which may endanger health, safety, or well-being of the residents;
-You are notified in writing of the violation;
-You have failed to contract with someone to do the repairs within five (5) days of receiving written notice or you fail to substantially complete the repairs within fourteen (14) days of receiving notice;
-The tenant did not cause the violations;
-The tenant must deduct only reasonable amounts of rent in light of the violations and alternative corrective measures; and
-The tenant did not unreasonably deny you access to make repairs.
-The tenant is limited to a maximum deduction of four (4) months in a twelve (12) month period. If your tenant does not wish to make repairs, and the problems have been certified by the local Board of Health to exist as described above, the tenant may declare the tenancy void and may leave within a reasonable time so long as, the tenant pays the fair rental value for the time s/he occupies the apartment (M.G.L. c. 111, § 127L).

Make sure to read the fine print in your lease. If there is nothing there you may want to address this with your landlord prior to legal action.

thats the whole reason you rent..so you dont have to pay for those repairs..take his a$$ to court and make sure you bring your letters or whatever saying that the tenents have to pay... the best way to win is with proof..good luck

No, that doesnt sound right at all. It is your landlord's property, so it is his responsibilty to pay for maintenance like that. Thats the joy of ownership. The only thing you should have to pay is for damage you cause that has to be fixed, and generally that just comes out of the security deposit. I'm definitely sure its illegal for him to charge everyone.

That is illegal. Check your fine print on your lease to be sure he didn't try to include that in there, and if he did you can still take him to court for it. That's illegal and you have every right to not pay those bills and to fight it. They are responsible for those repairs, not you. That comes with building maintenance, and if the apartment complex is too cheap to make those repairs that they are doing an illegal activity by assuming tenants are too stupid to question the maintenance bills in their mailboxes, then I'd move as soon as my lease was up.

Just be sure from now on when you drop your rent check, bring a receipt book for him to sign saying he received the check. He seems slimey so I wouldn't take any chances with anything.

Call the housing authority and the DA. This guy is out of control.

The ONLY repairs apartment dwellers ever pay for is those they caused. If you broke a window, ruined the carpet, then you pay.

Upgrades and building maintenance are NOT your bills.

This is illegal and your city should take action against him. After you contact the DA do not be surprised if you hear from a few attorneys willing to help you and your fellow tenants with a class action law suit.

Start by calling HUD....(housing urban development)....I am sure that is not legal ! They can raise your rent due to upkeep on the property, but the repairs are their responsibility !
