kellygrace | Are these buyers trying to pull a fast one? |
In a nutshell - we put our house up for sale, got an offer for $315,000 and negotiated to $325,000. All parties signed off. Contingencies were: appraisal, inspection and financing. Buyer indicated on contract they were going conventional loan with 35% down. Home appraised at contract amount, contingency removed. Home inspection passed (one minor issue which we fixed) and contingency removed. 10 days later, we get a call from our agent saying the BUYERS are asking us to sign and addendum to change the contract to allow them to go FHA. We said sure, we'll sign it but we are adding to the addendum: contract price remains at $325,000 regardless of new FHA appraisal and we are not responsible for any additional repairs or will not incur any additional expenses due to buyers changing loan types. We were simply asking that the original contract remain in force and we don't care that they get an FHA loan. Buyers agent is giving our agent a really hard time about the addendum and it has now been three days since we signed the addendum and buyers haven't signed it yet. FHA appraisal happened yesterday.
What is going on here? Please help! Apparently they didn't qualify for the original loan, but never told us and just went for the FHA. We thought everything was good once the appraisal and inspection contingencies were removed and were just waiting for the financing to go through. Now we feel they (being very skeptical) that maybe they lied on the purchase offer to make their offer seem more attractive (we actually had four offers in the 14 days our hosue was on the market).
We also feel that they didn't expect the home to appraise at $325,000 since everyone on the planet told us there was no way it would, our agent, their agent, agents of the other offers. WE did NOT hire the appraiser, but it did appraise at $325,000. We kind of think maybe they just changed lenders and went FHA to try to get a new appraisal hoping it would appraise lower.
I know I am making a lot of assumptions here, but I feel like we are being given the run-around. If they try to say they cannot get financing, what type of proof can I get?
Any help or advice is appreciated. Please let me know if additional info is needed. Thanks! |
