Are we as landlords responsible for a broken toilet seat?
We rent a property to a lady, who has lived there almost 18 months. We fitted a new toilet seat when she moved in. The company who manage the letting have informed us the seat is cracked. Are we responsible to change it or is she just being cheeky. We had the whole place decorated before she moved in and supplied a new cooker so we do try and look after her, however she must have broken it so are we responsible to replace it?

Thanks for all the useful advice. Just wanted a quick response. Interested to know how far we are responsible as she has said she broke it by standing on it. We intend to replace it anyway as we are not stupid enough to risk losing a good tenant, however we are not mugs and there has to a line drawn with how far you go to keep them happy. For example, she has asked we that repair the neighbours fence!!!To all the comments that we are making money from it, well we definately not at the moment. She gets the rent paid for by government and we have to contribute to cover the mortgage payments. We did this to benefit our children as it will be theirs in future. It will be sold when they need funds so hopefully house prices will rise again, and thus will fund university or deposits on their own properties. My arent we selfish!!!

There will be Wear & Tear, which is why the Inland Revenue allows 10% to be written off from annual earnings.
The Big Picture here is the rent coming in and a cracked Toilet Seat the detail. Once the property starts to get distressed, less care is taken by the Tenant and you are in a downward spiral.
It's in your interests to get it fixed.

Buy a $10 toilet seat next time and not one at the dollar store. Do you think she intentially broke it? If not then you have to pay for it.

I'm a landlord and if the only thing that went wrong in 18 months was a toilet seat, I'd be happy as a clam.

I am a landlord. You know what - a toilet seat only cost about ten bucks - just buy the thing.

If she is a good tenant - replace the seat. it's not worth the hassle for the small cost involved. If it comes to a row and she moves out you will lose a month's income and could end up with dreadful tenants. Take it from one who knows, buy the seat.

I would fix it just because you want to keep your renters happy. And a toilet seat is not expensive I would say yes as a landlord fix it

This would be damage, not maintenance. How long does a toilet seat last? 20 years?

But, it is only a couple of bucks, I would buy it just to avoid whining.

But, if she is fat enough to break the seat you may want to have the foundation checked, she may be damaging your sub-floor with the excessive weight.

I think the laws are different according to country and state. I am a landlord and from what I know you would have to replace it. Unfortunately trying to prove that she broke the toilet seat would end up costing you money in court, more than the cost of replacement. She could say the toilet broke simply through general use (tenants can damage property if it is considered to be in general use.
However, I would take my time! I don't think a toilet seat is considered an urgent repair (gas leaks etc.. are).
In Australia, where I'm from, the government provides a little booklet which details tenants and landlords rights. If you have an agent managing your property speak with them, they may have such a book.

I would say she broke it, she replaces it (or pays you to have it replaced).

In all my rentals, the tenant pays the first 50 for ALL repairs.

If your in UK, then normally if the tenant has broken something that was intact when she moved in, she should be the one of replace it. But seeing it is a small cost and if the tenant has been a good tenant, then I would pay for it.
One thing to remember, the seat needs a contractor to fit it ! This may not be cheap, contact the agent and put a limit on the cost.

It depends on the terms of the lease. But it seems it's you that is being difficult.

Fixtures and fittings are down to the landlord/lady unless you can prove vandalism or similar.

Stop being penny a pinching landlord/lady and get it replaced.

If you have not got anything in a contract saying the tenant is responsible for any damage caused (which is what a broken toilet seat is, got to be damage caused), then no I would imagine its your responsibilty.
Me personally if I was renting of someone would just go out and buy a new seat if I broke it, but there are alot of dickheads in this world that wouldn't.
Bet if she purposly broke the oven, she would expect you to get it repaired ! If you have to replace it mate, I would get her out asap and in future get it written in to a contract in future, I would not leave her in now you know what sort of person she is !
