me and my partner letted out a flat for 6 months
we didnt want to stay anymore because new loud mouth neighbours moved in upstairs
so we moved our clothes out and left the rest there to be picked up this Thursday (17th July)
our bathroom was in a state (leaving a bit of an odour) because we used to have cats but i haven't managed to clean it up as im busy running a business
my partner broke the bathroom shower rail but it was already in bad condition when we moved in, but paying for damages isn't something i mind doing
the landlord has been ringing me and my partner non stop today, i dont want to pick up because i hate confrontation
from what i've told you
does the landlord have any right entering the flat before this thursday?
and can he complain about the messy bathroom before thursday?
should i be worried or should i just get the rest of my stuff and let him keep the deposit no questions asked?

I am not sure what your asking because he might not even have a complaint.... he might just want to talk to you about your deposit. Give the guy a call and see what he has to say before worrying about it.
If you planning to clean tell him, if not tell him to keep your deposit......
He might have someone he wants to show the flat to and your not picking up the phone. |

landlords typically have the right to enter IF they give you notice or if the unit above yours has a water leak (so some sort of emergency). Have you already told him you are moving? If not, he is probably concerned that you are skipping out on your rent. You will likely have to pay damages for the shower and if the floor needs to be replaced for cat urine, you will have to pay for that too. Either way, I would call back, by not picking up he likely thinks you are doing something dishonest, not that you are trying to avoid confrontation. |

He has to give you 24 hrs notice before entering, if you want your deposit back you should leave it exactly as you find it, if you have left before your 6 months is up he is entitled to keep your deposit as compensation for monies lost. |

The landlord could let himself in if he isn't sure if you are still there or not, it depends how much you discussed this beforehand. AS you mentioned that you aren't answering his calls I suspect he wanted to find out whether or not you had left and how much work he'll have to do to the place before letting it out again.
He can certainly talk to you about it, but he shouldn't 'complain' until after you have officially moved out. Then again, the bathroom should have been in too much of a state anyway.
Just get the rest of your stuff as you planned, but let him keep the deposit because it sounds like you left it in a bit of a state.
My dad's a landlord, its awful having to clean up after other people. And its so so frustrating when they don't answer the phone! He probably didn't want a confrontation either, maybe he just wanted to know whether or not you were still living there! |

He shouldn't enter without 24hrs notice (unless it's an emergency.)
He might just want to show the flat to potential new tenants.
With regards to the bathroom, he will probably charge you for the rail, as broken doesn't come under reasonable wear and tear.
Bear in mind, if you need him to give you a reference in the future, he'll give a more favourable one if you leave the flat in a good state.
Unless it was a prior arrangement that the cats were allowed, you may also be charged for cleaning cat hairs/smells.... it sounds like you're not bothered though, just don't expect much of the deposit back, or worse, you might end up owing him. Watch out, he might look for other things to charge you for! |

If you are breaking your lease, then you should forfeit your deposit. If you did damage, you are liable for the repairs, especially if it is more than the deposit. As for the landlord, I think they have permission to come in when they want with notice. If you aren't there, you may have missed the "notice". I think it sounds like you need a change of scenery, so move on. Be careful that you have fulfilled your contract though, because they can report you to a collection agency for the damages. I actually had a very similiar situation to this.
I moved out because of unruly roomates and a shooting in a neighboring apartment. Roomates moved out months later, but broke the lease. A collection agency called me a year later and said I owed 1/3. I paid just to keep my credit and had them sign a release for me.

I would answer the landlords calls and tell him you are going in Thursday to clean etc and he can check thereafter...don't give any reason to loose your deposit..ignoring the calls may give him the impression you have done a runner....be honest! |

The landlord has no right to enter The property until the 17th. He should give you 24hr notice before entering, but you do not have to let him in.
By entering the property before the 17th, he will have difficulty in proving any damages and he may have caused them.
If your contract is till the 17th then it is your property until then, and only after that day, when you have returned the keys should he enter the property, and do an inspection.
Don't let him keep the deposit, that is what he is after, arrange a time to meet at the property on 17th and go through the check out with him, its better that you are there then you can discuss any problems at the time. |
