Well, we had a tenant who was overdue and owed us ALOT of money so I had him evicted, by court order. He abandoned the house and when we checked he had left alot of damage to the home and property. Do you think we should leave the property as is until we go to court, or do you think that it is alright to start cleaning/fixing up the place for new tenants? Please help. |

I'm sure you have attempted to contact via phone and that has not been successful. He abandoned the place too, you say? Chances are he isn't going to show up to court. Take pictures and video recordings of the place as evidence. Then start to fix it up and do the repairs so you can get the place ready for the next tenants. You should have a security deposit as well that they should have given you when they first moved into the place. You that to start the process of fixing it up. When you do go to court bring the amount that he owes and an estimate of damages that they had done. The ball is in your court. You can sue them. This is tough for you. Good luck! |

Take dated pictures before touching anything inside the house. This is going to be your only proof. Once you start cleaning and fixing up the place, keep all of your receipts to prove the cost of repair. Take more pictures during the repairs and once the repairs are completed.
Document, document, document (CYA, CYA, CYA) then hire a good real estate attorney. If the tenant skipped out on you, he maybe hard to find or the attorney may tell you it's not worth the battle. In any case, make sure the next person pays you first and last months rent plus a security deposit. Also, if the next tenant is from the area, drive by where they currently live to see the condition of their current place, it could tell you a lot about them. |

Photograph & document everything, keep records of your expenses getting the place "marketable" again....but be warned: if you did not have a security deposit arrangement with the evicted tenant, and have no record of condition signed by him when he moved in, you have no case! Sorry...

Befor you fix it up take lots and lots of pictures of all the damages with a camera that date stamps. After you get the picts. go ahead and start cleaning up. The picts will be great evidence for the judge. |

take alot of pictures and clean it your losing rent. and it doesn't sound like your going to get the money owed you from this deadbeat. Get a lawyers advice but it will go to small claims court where there are no lawyers but advice is cheaper than handleing the case |

Hi, that's to bad, I can't believe how people can be! I'm not a professional, just wanting to help and give suggestions. I live in a duplex, when my neighbors moved out, they also left a mess as you described. My landlord paid me to make several repairs such as replacing light fixtures, doors, faucets, patching holes in the walls, painting, cleaning the carpets and other things. I spent approximately 2 weeks working on the duplex. After I finished all the work, I submitted a bill to my landlord, she refunded all the money that I spent on the materials to make the repairs and for the labor. I charged her a total of roughly $2,000. When my landlord went to court, she took the bill that I submitted to her for the repairs, along with the other bills from the electrician and plumber, and sued the former tenant for the reimbursement of these bills. Honestly, If the court date is not too far away, I would wait for the court process to get over, and maybe he might be the one owing for the damages at the end, it is one thing I think you should bring up at court and just make sure something gets done about, either before the court date or after, and then maybe start cleaning up for new tenants. Hopefully that was helpful. |

Take pictures and start fixing by not renting you are losing money right? Don't be surprised if you don't see a dime of the money owed you.Tenants seem to think they can walk all over you,and with the laws in my state they can!
Before moving your next tenant in take pictures of the place the day before they move in and have the front page of that days paper in the pictures to prove the date.
Tenants always say it was broken when I moved in etc.
You should see the look on there faces when the pictures come out!!!! |

1. As L/T laws vary from state to state, go see a lawyer/barrister for advice, you may be able to take the case to small claims case, depending on the amount of damage. |

Take photos and get your records together b/c if you want to get anything you will have to take him to court. If he doesn't have any money, you might as well forget about it b/c you will most likely not get anything. The system stinks and caters to the bad tenants. There is a chance that if you claimed rent on the eviction that when he is brought to court you could mention that during the evicition, but I believe it will be a different case as all the judge cares about is if the tenant paid the rent and if not, in most cases he will be evicted. |
