I am going to rent my house out soon and I am leaving the washer, dryer, stove, fridge, microwave and dishwasher in the house. If any of those items break without no sign of abuse would I be responsible to replace them? If so, do they have to be brand new or good working order? I realize you can probably specify in the lease if they are included or not, but what is the general rule of thumb? Thanks |

Generally, any major appliances that are furnished by the landlord are the landlord's responsibility if they break. The items that a person/family requires are stove and fridge- they can really get along without the others so they could be considered amenities and not necessities. But at minimum you should take the responsibility for stove and fridge. Whatever needs replacing, you can choose if they are new or just in good working order, it is up to you. You should also know that if you give over total responsibility for any of these items to the tenants, they usually have the right to take the items with them if they leave. Otherwise they have paid for improvements to your property which really isn't fair. |

Yes, you would have to repair/replace, and it would not matter why or how it stopped working. You have to leave a stove, but the rest is optional and I would not do it.
If you use a standard lease form there should be a place where you list what is included. You can specify that those items are your personal property, being borrowed, not rented to the tenant. However, I can tell you from personal experience that if they play dumb to a judge they will win this, that they were "tricked". Of course if these appliances are built in you have to rent them, not lend.
The other option is to "sell" them to the tenant for a buck. I "bought" the refrigerator in my rental when I was a kid this way.

I own a house that I rent out. The property management agency I employed told me that if the washer and dryer are part of what I rent, then I am responsible for their upkeep. They recommended I take them out.
However, I left them for the clients. I've had to repair one.
I would prefer to be a "good" landlord. |

If appliances are advertised as included, then landlord stands behiind the working order of these appliances. A replacement doesn't have to be new, just in good working order.
Bottom line, if advertised as such, tenant has the right to proper working appliances.
If you specify in the lease that they are not included, but you leave the items in the apartment, Or if tenant doesn't want the items, the landlord is responsible for removing them. |

If they are yours, you are responsible for their upkeep. Something like a microwave or a dishwasher, which is optional, you could remove from the lease, if you really wanted to, but they also increase the value of the lease to a prospective tenant.
But really, why would you want to leave your tenants to look after your property? Yes, you can replace them with similar, good working order equipment.

You have two choices; sell them to the new tenants as is conditions, or include them as a bonus to the tenant. Maybe they will not need to get a professional mover to move their other items. If they break down, buy nice used appliance. When you are renting you can not specify what brands that you want.
I rented a house once and they had the stove, refrigerator, washer and dryer. I was there a year and none of the appliance needed repair. All of them were different manufacturers.
I was grateful that I did not have to go and purchase these appliances. |

My daughter rents a house where the stove, refrigerator and built in dishwasher are in place. If they need service her landlord provides it. She has her own washer, dryer and microwave. If you don't want to be responsible for service calls take them out although most rentals as least have stove and refrigerator. |

It's common for landlords to provide fridge, dishwasher, stove, and built-in microwave. We include a clause that tenant is responsible for repair if appliance technician determines damage was due to abuse. In our experience, it seems dishwashers are most often damaged by tenants bending the door or in need of repair (solenoid replacement).
Washers & dryers can be overloaded and worn-out much faster than kitchen appliances, so many landlords do not provide these. If you don't plan on replacing W&D, include a clause that the W&D are provided "as is" and you will not repair or replace.
You should also consider if you can purchase home appliance insurance. There are policies available that will over repair/replacement. |

Yes they are the responsibility of the landlord to keep operating. And to replace if necessary. You might check with your local utility to see if they have a budget plan for appliances. Some gas companies and electric companies offer this. It costs a little more each month, but you could add that cost to the rent. Then if something breaks, you call the company to have someone come out and fix it. It really is worth the extra few dollars. |
