My home currently has its water shut off, and wont be fixed until later tommorrow, I cannot flush a toilet (so no going potty for me), cook dinner, wash my hands, or shower tomorrow morning before work...is this unreasonable for me to ask for a hotel room?? Does anyone know the legal rights I have or a landlord has with this issue? thanks you Additional Details the pipes were frozen and the landlords actually have a management company they use, so we dont talk to them, we called them this morning around 11am to tell them the pipes were frozen, they sent over someone they use to come and look at it, the guy put an ELECTRIC heater underneath the kitchen sink and turned the tap on in the kitchen (even tho there was no water coming out of it) oddly enough at this point every other tap in the house worked, apparently this pipe was seperate from the kitchen one, and before he left he said to turn another tap on and leave it running because the main pipe was about to freeze, he also said that water would NOT come rushing out, well within 3 hours, the pipe busted, and water rushed everywhere outside, so now we have no water, we had to turn the taps off, this was at 5pm, its not 9pm and someone wont be here tell tomorrow after 10am....good think we unplugged the electric heater from underneath the sink !!!

In my opinion you have every right check into a motel/hotel for the evening. I cannot believe one poster said that your place is not "uninhabitable". You cannot go to the toilet, you cannot bathe and you cannot cook your meals. What are you suppose to do?
Providing you do not book into a 5 star hotel I would do it and keep all of your receipts including meals and submit them to your landlord.
The way I see it, if the pipes had been properly insulated this would not have happened. Regardless, your place is uninhabitable. Your province will have a "dispute resolution" office or arbitration branch to deal with residential disputes. If the fault was not yours then I see no reason why an arbitrator would not make you whole should the landlord refuse to compensate you. Being made whole means that you should not be out any money. |

The legal requirement is that if you are to be without water fro more then 24 hours and it is not something the landlord can control (such as the cities main water line being shut down, the problem has to be exclusive to your house or apartment building) the landlord has to compensate you 1/30th of the monthly rent for every 24 hours in order for you to stay elsewhere.
They do not have to pay for your hotel, you can pick any hotel you like, but they need to chip in the daily unit rent. |

I now from my own experience they wont usually pay for anything unless it was their fault and your "inconvenienced" for more than 24 hours. |

You probably would come closer to having the cost of the hotel deducted from your rent than having landlord pay for the hotel. Make sure you make all requests in writing. Verbal agreements just don't hold up. |

It's not unreasonable, but improbable. It's rather like asking your car dealer to give you a new car to drive while you're car is being repaired. Not going to happen. You failed to mention why the water was shut off. If it's the landlord's fault, you might file a claim in small claims court, but then you should also start looking for another place to live if you do. Best bet, just suck it up as a lesson in life. |

You could ask for one day discount on the rent (prorate the rent), and use the money to go to the hotel. If your landlord agrees to give you one day discount, have it in writing.
What's happening to you is inconvenience. Your rental place is not inhabitable. You can sleep there and you don't have to move out. Therefore, it's not illegal for the landlord to inconvenience a tenant for a repair. You will have a hard time having your landlord to pay for a hotel bill. |

Wow, who was the moron they sent over to turn on all these taps! Sheeesh! What I would do since you cannot shower etc to go to work tomorrow is go to a hotel that is reasonably priced, and take whatever the amount you had to pay for the room is, take that off of Januarys rent. I would inform the landlord or their agent first though that you will be doing this, as I do believe since THEIR guy caused the problem to begin with! |
