At what point is a real estate agent being a bully and at what point are they helpfully guiding?
My fiancee and I are buying a house that is livable but needs a lot of work. All parties in this deal know this. The seller's agent is being abusive since receiving our home inspector's report. The house is a decent deal and we know it is a fixer upper but for the seller's agent to be completely be abusive after asking for some concessions is starting to scare me away from this deal. If we walked away from it at this point, we'd be losing less than $1,000. I am not sure the owners are on the same page as their agent as they prefer to deal through their attorney. Does anyone have any advice or insight? Thanks.

We do have our own real estate agent. She is not running interference at all. It just seems as though she is taking a beating from the seller's agent and is not standing up for us. Our attorney is doing a great job of standing up for us. Now that i've re-read it, she protected us in several instances if we back out of the deal.

If the seller's agent isn't being an ideal business partner, walk away from the deal.

While a $1,000 loss sucks, it is likely you will give up more than that in the concessions the agent is asking for.

View the $1,000 as a sunk cost. If you were walking into the deal today, is this someone you would do business with?

There is your answer about whether or not to proceed with the purchase.

Are you using a Realtor to represent you? That would be the job of your agent - to make this deal work for YOU, to take your side and be the brunt of any abuse. Don't be afraid to ask your agent to step up on your behalf.

If you are not using a Realtor, I would recommend not letting your emotions get in the way of what is important in this deal - and making sense of the big picture.

I would hate to see you lose your $$$ or your opportunity to buy this house. See if you can do a face to face meeting with the seller's agent and try to communicate clearly, nicely and firmly until your issues are resolved.

Why would you lose the $1000 earnest money? Seems if you're not buying, it should be returned. Did your agent write this contingency into the contract? Seems they should have. Do you have a working relationship with your agent? It sounds as if you do not.

At this point you should not be loosing anything if you walk away. If there are major thing that were revealed by the inspection those need to be addressed by the seller OR they give you back the earnest money and you go your seperate ways.

I was in exactly that same situation. We peacefully went our separate ways.

Leave. Or if you stay, don't back down on what you want. Don't take the abuse. Call the agent on it. Tell her or him that their behavior is unprofessional and unacceptable. It's ok to say that you don't have a problem walking away if he or she is going to act that way. The agent is just concerned about his or her commission. If the agent doesn't want to go for what you are asking then walk away from the deal. Know what you want and be willing to walk away. Don't get emotionally attached to property.

dont make any concessions ... perhaps something is wrong that the inspector missed and the agent did not .. fight fire with fire ...
this could be why the seller will only talk through counsel. ... better re-think this and consult your bank's attorney ... they will be the best advocate now ..

Yes, the problem is you think that the listing agent is supposed to be working in your best interests and they ARE NOT.

You need your own Realtor...did they state that they would give you a 3% discount for not using one? Or is the seller's agent keeping the full 6% commission?

That is why you need your own representation. How do you know that you'll lose your earnest money if you walked away? Did you read the contract? Did it have an inspection contingency? Were there any limitations or did you sign every right you had away?

You see now why you needed help?

You are dealing with an experienced professional that clearly knows the game better than you...you need to get your own to level the playing field or else she is going to continue to bully you...b/c she can.

If you think you are being treated in a way that is less than professional, you may want to consult with your state's real estate commissioner or your local real estate board to report your concerns. If you are employing an agent, it's the agent's job to run interference. You don't have to accept unacceptable behavior from a licensed professional. Report them if necessary.
