You can change the terms of the lease IF your tenant agrees with the change. If they don't agree, then you are stuck with it until the term expires.

NO! You CANNOT change anything on a lease mid term. You can only change things when the lease is renewed.
If they are on a month to month then you can change anything at the beginning of a month and with 30 days notice.
Kind of - they are technically late by paying on the 5th, but with the 10 day grace period you cannot charge late fee or do anything about it unless they pay past the 10th. |

Your lease agreement will have certain stipulations on it I'm sure ..such as when they are obliged to pay the rent. If they are not adhereing to the original agreement then they are in breach of contract. There are probably details of what either party can do in the contract when a breach ocurrs. These will include periods of notice for any changes in the agreement. As long as you adhere to the periods required you can change the agreement. Make sure you get any new agreement signed and witnessed if you can. |

If there is a written lease, then generally it cannot be changed unless both parties agree to the change. Is the lease instantly renewable or do you need to renew it. If you do have to renew the lease at the end of your tenants lease, then you may make the necessary changes then without them agreeing to it. If you want to evict your tenants, you can do so without any notice at the end of their lease. If you do not renew the lease, but continue to have your tenants living there, then they are classed as a month to month tenant, which means they have an unsigned agreement until the end of that month from when you took the money for rent. That basically means give your tenant notice for a month.
If I was you, I would consider getting yourself new tenants, because if they are causing you trouble now; then the chances are they will cause you more in the future. You can't beat a good tenant |

Leases can be amended at their expiration date -- usually year to year. Be more careful about your next tenet -- always check references, but be careful. I had someone give a good recommendation to someone who wanted to rent from me, just so they could get rid of that same tenet. That was a surprise. So U really can't be too careful. Ask for references, follow up on them, and use your own intuition about how these people are going to fit into your rental. |

If you're in a fixed lease term, you can't change any of the terms until it expires. And if your lease gives them a 10-day grace period to pay rent, you have to stick to that and can't evict them for paying 5 days late. Yes the lease can be changed if both parties agree mutually but I doubt that will be the case and you can't make them agree to it. |

I am sorry to say that you can't force them to sign a new lease not if the old one is still in date.HOWEVER if you can get them to agree to sign a new one as though you may have misplaced your original copy here's a good way ( agree to back date it from the original date of the first lease) this will help in putting their guard down.
Is there a date that rent must be received? If so and you can prove there rent is generally late then you can make them move. You just have to go to your local courthouse and ask for a eviction notice then the officers will serve it. Depending on your state determines the amount of time they have to leave the property. If any damage is done then small claims court will make them pay plus any fees or court cost you are out of.. |

Consult an attorney in your state. Landlords really tend to get the shaft while lousy tennants are well protected by law in most states. Even if they are violation of the lease you can still lose in court. Get real, legal advice on this one. Good Luck. |

Being a landlord myself, I wouldn't worry about the tenants being a little late. There could be a reason and you should be understanding.
If you have a problem with them paying late then add a late fee.
You can rewrite the agreement and stating that there will be a late fee charge. I went from monthly to weekly because I wanted to make sure I was going to recieve my rent. If I didn't get it within 2 weeks they were evicted. Just some tips from an experience landlord. |
