Bad tenants?
i have rented my flat , i never use to get my rent on time so i have given them notice of 4 weeks. On that my tenants did not agree on this and wanted atleast 3 months, after negotiating he agreed on 6 weeks which is 31st of March. i have got it all in writing and made them sigined on the notice.
what right i have if they decided not to move after 31st of March.
i have a feeling they might damage my properties or will not pay for this period.

When you rented this property to those creeps, where was your written agreement - your lease?

You're "letting the tail [the tenant] wag the dog [you - the landlord]". YOU ARE supposed to be THE BOSS.

Here are your choices:
1] Let them continue being the parasite. You have expenses to pay - every month. Their rent is expected to be paid - each time, on-time or ahead-of-time. Period.

2] Go to court and get those idiots thrown on the street.

3] Next time, please hire a professional real estate rental agent: Someone to get a good, clean, qualified tenant, who will take proper care of your property - ready, willing and able to pay the rent each month - on-time or ahead-of-time.

You gave them too much. You needed legal advice. If they're behind, why give them all this time. Did you file against them? If they haven't paid as agreed in the new agreement, exactly, file against them. It takes time to have some one evicted. Get legal help.

I hope they have paid you a good deposit. so, if they damage your property or don't pay you what they should pay, you don't give them the deposit back.

The same thing happened to me once and since then I have always gone through an agency. At least then you have peace of mind that the agency will deal with these matters should they arise. The agency will also guarantee you the rent money even if the tenants do not pay. The only downside is that they take a percentage of the rental charge for this. I think it's worth it though for peace of mind.

You should have stuck to the 30 day notice as that is all you have to give them.Now that they have it in writing that they have until march 31st, your stuck with them until then. Hope that they don't do any major damage and they should pay rent until they leave, but if they don't you can withhold it from any security your holding.

I had a tenant who was behind 4 months. I gave them a 5 day pay or get out notice and they paid up.

Check with a local attorney on the specifics for your state laws. Usually as a landlord you can give them the 5 day notice (hand delivered or certified mail). If they fail to pay they are required to remove themselves and there belongings from them property by the end of the 5 days. If they don't you take them to small claims and the judge will have law enforcement remove them from the property.

Under no circumstances should you ever try to remove them yourself. It is illegal and will cause more problems for you.

Unless you have a proper written lease agreement, you may have difficulty getting them out, you may even have to go to court.
In future, you shouild use a letting agency, they will charge a commission, but will ensure your tenants are properly vetted and insured.

If it was me I would ring them up and ask when would be a convenient time to come round and discuss the matter in person, that way you do not come across as some kind of ogre, lost of people are struggling for money, and people in rented accomodation are often on low income, I also understand that getting the right tennants isnt easy, but a friendly landlord would be a nice place to start.
