Behind on Rent Landlord changed the Locks to the Storage area?
We were 10 days behind on our rent and our Landlord changed the locks on the Storage unit int he basement and left us a note saying that if we dont pay he will evict us and keep our stuff as colaterol until we pay. Does he even have the right to change the locks on the storage unit? There is nothing in our lease agreement about any of that.

I dont think 10 days is to bad we have a 5 day grace period. So really we were only 5 days late.

Please help. Dont know if state laws are different bu I live in Illinois.

Oh Yeah and we paid the Rent on the 10th it is now the 16...He still hast changed the locks back. For all he knew I oculd have kept some medicine in there that I might have needed

if you are behind on your rent, the landlord needs to serve you with a 3-day notice to pay or quit (get out).
he cannot hold your belongings right now...but if you were to leave and not pay the rent...yes, he can hold the property and sell it - after he has notified you of his intent to sell in writing.

look in your white pages for Renter Advocate or Renter Assistance...or Legal Aide Society....they can give you wxactly what you need to do.

Put in writing to your landlord, that your rent is paid in full, and you are requesting that he release the lock to your storage immediately. (keep a copy of this document for yourself)...finally when you get access to the storage, take everything out and put it in your apt.
also...start looking for another place to live...cause this is probably not going to end well.

You are a victim of what is called "Self Help Eviction" and it is against the law in all states that I am aware of. You need to check to see how the law protects you here:

I haven't heard of any state that this would be legal in. Besides tell him you need to sell the stuff to pay the rent and move it all somewhere else.

I am a maintenance supervisor in OHIO and I know for a fact that he has no right to change locks on anything until evict. has been processed and comes to set you out. only after that can he change locks on anything.Also be on the look out for an abandonment letter.

Ranae,This is are little harder question than your computer problem,but I'll try.The purpose of a lease is to protect you as the renter and the landlord. If your lease is on a month 2 month agreement,the landlord can evict you at any given time providing he gives you a 30 day notice.If you have a 12 month lease you are intitiled living at said property until the lease expires. At that time he has the right to renew your lease for another yr.or not but must give you 2weeks or 30 days depending on your state laws to find another place to live. If you have been late several times with your rent I beleive he than has the right to end your contract. As far as changing the lock on your storage unit,I think he was out of line,especially if he did not call or give you written notice. Also,do not cut the lock,this will possibly put you in breach of your contract.Instead,sent him a certified letter,he has to sign for this,explaining why you were late and to allow you to have access to your storage unit. If he accepts your explanation and is decent landlord,everything should go back to normal. In case there are other issues i'm not aware of be sure to make copies of all tranactions for yourself. If he has already excepted your rent payment,chances are this will resolve itself. I wish you the best of luck,CRUTCH. PS. keep me posted.

he has NO rights to change any locks, the eviction notice is quite legal but changing of locks IS NOT.

Illegal.. he cant do that...in any state..he cannot touch anything..locks power, gas, water..ect...he has to file an unlawful detainer and wait the legal course before taking any action..and even then only a marshal of the court can physically remove you.
You might be able to have him arrested and sue him...call the police..they should be able to force him to remove the lock.
If you don't want to wait that long..cut it off yourself.
