Bought a house, Old occupiers left items in it, been 5months now they want it back.. What are my rights?
Bought a house 5 months ago, The previous occupiers left a few items behind, and an order came through for them. I didnt have contact details and assumed they would be round to pick the items up! However 5months have passed now, We have got rid of the items as we didnt think they were obviously needed but old occupants. Now i get a knock at the door wanting them and they will take legal action.
Im pretty sure there is a time limit to when "possession is 9 tenths of the law" Senario kicks in.... can anyone help me?

A light fitting and a curtain pole, When we moved in the strip light in the kitchen didnt work (someone had cut the wires!) The boiler didnt work, we had to call out an engineer, But i didnt get hold of my solicitor and sue them, as you take possesion of that property, Plus couldnt prove it was them!

Oh the house wasnt through an estate agent, I had no one to contact regarding the items. (shared ownership house!) They were pains all the way through the sale...5MONTHS! just bites the biscuit!

Howdy mate. What were the items exactly? I'm guessing nothing of too much value? How did you dispose of them, garbage, re-sold them yourself or what? I'm sure you have absolutely nothing to be concerned with. When you buy a house, it is set out in the contract of sale (section 32) what goods and or chattels come with the property. Also, and this is the most important part, "the property is offered with vacant possession" on whatever day the settlement falls on. It is the responsiblity of the seller to clear all items out of the property before handing over keys etc..to the agent or if it were private sale, directly to the purchasor or whatever.
Now, given that this is the case and most reasonable people like yourself have given these people more than a satisfactory period of time to collect their things and they haven't.
Just a bit curious as to why you didn't have contact details. Did you contact the real estate agent? No forwarding address details? Either way, this isn't terribly important. The main thing here is if the items were of that much value or they were that important to them, they would have made it their business to get in touch with you to arrange to pick them up. And certainly not after 5 months. I'm just trying to think who you could ask to be certain here, but try just ringing your local police station and just give them the crux of things. I'm sure they will probably tell you the same thing. Hope this is of some help. Cheers, Tony.

The moment you closed on the sale of the house, every item on that property became yours. End of story.

If they want something back, you can give it to them if you choose. But they have no legal right to demand the items back. They can't sue you for getting rid of the stuff because you owned it. Its their own fault and they have no legal recourse.

Those items should be yours. Look at your contract, there should be language that essentially states that any items left by the seller on the premises after closing will be deemed property of the buyer unless other arrangements are agreed to...if there was nothing agreed to, in writing, at the closing or beforehand, they are SOL (the law is on your side here, dude).

Speak to your solicitor. I would also charge them rent for the goods whilst in your possession. Cheeky sods.

Sounds to me like they are chancers. Don't be bullied, tell them that all contact should be through your solicitor and close the door.

Ask them for their copy of the storage agreement.

"What items? We cleaned out all the trash and junk the previous owners left behind."

Out of curiosity, what did they say they left? Priceless family heirlooms?

Go to the Citizens advice Bureau, they will let you know your rights and you won't have to pay for the advice.

once the document for complete possession of the house was signed by the new owners, the house and ALL of it's contents become property of the new owners and can do anything they want with the previous contents left by the previous owners. the previous owners don't have any recourse in trying to get those items back.

The stuff became yours once you closed on the house. Technically you could charge them for storage and disposal, but it's not worth the trouble.

Tell 'em to sod off. If they continue to bother you, charge them with harassment.
