Breaking a appartment lease, please help.?
My problem is my family is thinking of buying an appartment building, and are offering me an way bigger appartment then what I have now and its affordable. I would be able to move in this spring But my lease is not up yet on my current appartment. I started my lease with my landlord on sept 30th 07 and the lease ends sept 30th 08. Today checked my lease and it says nothing about breaking the aggreement. How can i break my lease with out breaking the law or having me owe alot of money?

If there is nothing in there about cancellation you are going to have to talk to the landlord/management company. See if you can get them to agree to something that is acceptable to both of you. But be sure to get it in writting and have them sign the agreement. This is so that they can not come back to you later saying something else.

Now, if your parents are only "thinking" about buying a building it is probably going to be at least a few months before you could move in anyways. So you may want to wait until you have a firm date you could move in to give your current place something to work with.

Find someone to take the remainder of the lease. Of course you will have to talk to the landlord about this. But, this will generally get you off the hook.

You stated the lease ends Sept 30, 2008. If you stop paying the lease then you are illegally breaking the lease. The lease agreement you signed is valid, legal and binding on both parties.

Now...is here someway YOU can find someone who is financially able to rent the apartment from the landlord so that the lease is legally terminated with no penalties and you would be free to move out?

Talk to the owner - they may have someone who is willing to pay the higher rent, and would make money with your leaving. Or, you could sublet it for the rest of the lease time. As a last resort - see if the penalties involved would cost less than the rent that your family is offering you - and consider it a blessing. Have a healthy and happy leap year!

Sometimes you will have to pay like two months of rent to move, or sometimes you pay the rent until they lease it out again. Im not too sure, I guess it depends on where you live.

One place I had I just had to pay two months of rent, and the other place, I paid the rent until it was rented out again. You might just want to go to your Rental Office and ask your landlord. Make sure you give a 30 day notice also. Or you can have a friend take over the lease if you want too.

Well, don't worry, you wouldn't be breaking the law and I was very nervous the first time I broke my lease because we found out that we were having a baby and got to house shopping immediately. All they did was keep the security deposit/first months rent and no problem at all since we gave them a thirty day notice (that was pretty important and i suggest doing that).

You could sub let? Check your lease aggreement and see if you're allowed to do this. Your sub letters will most likely be interviewed and have to be approved by your landlord company.

Check your state laws...but as far as i know you can find someone on your own to rent the place, or pay a fee for breaking the lease. Talk to your landlord, he may be willing to work with you.

The law is that you signed on for 1 year. But it depends on who your lease is with. If they are descent people sometimes if you kindly talk to them they will agree to break the lease as long as you give them enough notice to update and re-rent your apt. out again. You should just talk with them and see whats up.

talk to your landlord, and make sure you give him 30 days notice, since your leaving before your lease is over you might not get your security deposit back..just talk to him/her about your situation. good luck

You are stuck in your lease until it expires. The reason your lease says nothing about breaking it...is because you can't. Talk to your landlord about a buy out.

I was in a similar situation many many years ago and I just asked the Landlord and at the very same time his brother needed a place so I was able to get out of the lease.
