Aleeex | Breaking out of our tenancy agreement? |
My partner and I have lived in a self-contained flat since July 2009. Our landlady, while pleasant and generally cooperative, has been somewhat unreliable - she has often stated she will do things and not carried them out (not replaced a lock on our window, not fixed the grill on our window, not given us the code to the alarm system and not given the keys to our other windows, among other things), leaving us with several issues in the property we rent. However, they are all pretty minor things, so we've let them slide, and due to liking the property and its location, we agreed in January 2010 to extend our contract for an extra year (from July 2010 to July 2011).
However, recently we've had several attempted break ins. Finally, early last Wednesday morning, 5 armed men managed to smash our front door in whilst we were inside, threatened to shoot us (as well as stab us- they were armed with screwdrivers) and basically robbed us.
While the stuff they took is replaceable, we have been left pretty much terrified. We've not been able to sleep, we've been afraid to leave the house but afraid to be in it as well. We're struggling to cope with it and so we're looking to move out. However, we've committed to an extra year, which is due to begin on July 1st. We really can't stay, but I don't see how we can back out of a contract 2 weeks before it's due to begin. What options are there available to us in this situation? Additional Details We agreed to another year because as far as we knew, it wasn't a dangerous property. The landlady herself said that she had never had a break in at the flat before, and the previous tenants had no issue with it either. The attempted break ins and actual break in have all happened in the space of a two week period, after almost a year of having no problems of this nature whatsoever. |

You can give a 30 day notice to break the lease. You may be liable for the rent for the remaining months on the lease. The landlord will have an obligation to mitigate your losses by finding a new tenant. |

How awful--my heart goes out to you! Of course you want to move out--it would be so hard for anyone to live there after such a horrible experience.
GIVEN what's happened to you--AND the fact that your landlady has not looked after your safety--ie., she has not replaced a broken lock on your window, has not given you the code to your alarm system and has not given you the keys to your other windows (how, then, are you supposed to be able to lock them?)--I suspect that you probably are on good legal grounds regarding ending your lease (even though it sounds like you must be in the UK rather than the US, because you use the word 'flat' instead of 'apartment').
First, document everything you can remember, including the dates--regarding your verbal (or written--emailed?) requests to the landlady that she repair the various problems you mentioned. Photograph the broken window, etc.
But start by just speaking to your landlady and telling her you want out, that you don't want to continue living there after what's happened. Unless she has a heart of stone....
If she gives you a hard time, or says she won't give you back your deposit, then pull out your list of infractions (by the way, are all your smoke alarms working? Do you have the appropriate number required by law?) She has not looked out for your safety to date, so how can you trust her to do so in the future? [By the way, would having the burglary alarm in working order--had you been given the code as you should have been--would that have made the difference in whether or not you were robbed? MAJOR legal point on your side].
I think you can get out of your lease under the circumstances.
You use the word 'flat' instead of 'apartment' so I assume you aren't in the US. However, whatever country you're in I'm sure you can get legal services for a small fee. In the US you can get them through the various county Legal Referral Services (lawyers offer their services for a small amount, like $50 for 1/2 hour, because sometimes a big case comes their way through the referral service). I'm sure there's a similar service like it in England, or wherever you live. My family has used this service 4 times--twice over rental issues--always with good results.
But given your landlady's lack of concern over your safety issues, I think the law will be on your side.
