Breaking you lease, how can i do it?
I need to know if anyone knows who to ask or where to go to get out a lease...I have signed a lease agreement for 1 year i have a remaining $2500 on it....But i have to move 4 hours away for my new job. My recent job is cutting hours because there is no work to be done and Michigan sucks! So i have found a new place 4 hours away but obviously i have to move close to my work, is there away to get out of my lease? legaly without a a major penalty or am i screwed and have to pay for two places a month now?

I would just asked the landlord. They might let you off. Or ask if you can sublease it out. They might do that. The payment is still your responsibility but you can put somebody in that will help with the payment.

Good Luck, but I dont think you can break a lease because you have to move. Unless its written in the contract.

Since this is not a lot of money, but is substantial, get into a face to face with the LL, you may be able to apply your dep to the remaining part of the lease and forfeit to save something.
otherwise you get stuck with the total amt due and possibly a little small claims suit if its necessary to recover.
further, if you talk to the LL, it may save you some add'l costs not necessary because you've spoken.
place the remaining amount that you've agreed upon on a monthly or weekly pay out to avoid interest and costs & fees.

Talking can reduce some of your costs and if there is a deal struck, the LL cannot get double rents and if he rents it again within your lease period, that will be paid for by the future tenant on a pro-rata basis...and daily reduction of you indebtedness to the LL.

Convaluted, but talking & dealing works.
Your good credit is worth saving, but if you have nothing, you have nothing to loose but your deposits.
Is your credit good or will you need it spotless in the future?

Depends on your landlord or whomever owns the property. Some leases stipulate you are responsible for payment for as long as the apt remains empty once you vacate or it may just be forfeiture of your security deposit or some sort of flat fee. Your lease is a binding contract. Read it carefully for any loopholes or discuss with a lawyer.

Check your lease to see if there is a lease break clause. Typically you have to give at least 60 days notice and you still may have to pay an additional penalty. Go online to check leasong laws in Michigan, then find out what your rights are as a tenant. The landlord will obviously not want to lose money.... if you have like 4 or more months left on your lease, perhaps you can strike a deal where you will conitnue to pay until it is re-rented.

Another way other than subleasing (which may be an option if you know somebody that needs a place for a month) is assigning your lease. As long as you find a tenant who is willing to take it over with good credit, the landlord shouldnt have a problem. IF the landlord has a problem with it (assuming credit/job is good), in some states that may be enough to let you out of the lease with very little notice.

Well that depends upon how understanding your landlord is. If you give proper notice as well as offer to co-operate as much as you can in securing a new tenant, or subleasing the unit you may be able to get away.

Talk to you landlord. Explain that you need to relocate for work. Say that you are willing to assist in anyway to fill the vacancy, and take it from there.

It depends on the lease and how nice your landlord is. How many more months that $2500 covers is also a factor. What are the terms in the lease you signed?

It can't hurt to ask and discuss options with the leasing agent/landlord. They may cut you a break since you have to move (if they are nice...).

It's up to the landlord or Management company when there is a lease. In most cases you would have to buy out of the lease and lease buy outs are different from company to company. I would setup a meeting with the Landlord or Property Manager and give them all the details, and don't wait until the last minute or you'll just get slapped with a big fat NO!

Check your lease. You MAY have a clause that says 30 days notice is all you have to give, which means you will owe a month that you're not there. Not fun, but not a disaster. If not, then legally usually you are on the hook until they can re-rent the place. See if you have any options with the landlord--can you find someone to take over the lease? Get whatever you agree to IN WRITING. A written document is superseded ONLY by another WRITTEN document, not by "oral agreements." Make sure the person has the AUTHORITY to do this as well.
