Buyers Agent Says offer was Rejected?
I know this might sound weird, I feel the agent really didn’t even send the offer over to the Sellers agent. My agent called me back today after 3 days saying the sellers agent said no to the offer and to make the highest offer we can. Can I get something in writing from the Sellers agent? My agent didn’t get anything in writing just a phone call. What can I do ? I feel everyone is out to make a buck and someone is being deceitful. Do I even get anything in writing? Or is it all verbal.? And what if I do get somthing in writing how do I know its actually the real thing? Can I call the listing agent of the property and ask? Thanks

I believe I have a greedy agent and she knows how much I Qualify for becuse Im going thru her office to get financed.(BAD IDEA ) should have listened to my spouse. I just called my agent to ask for a written letter that they rejected it. She said shell call the listing agent and have her fax it. Similar homes like this that are CLEAN go for 250k they have it listed at 289k Ive offerd 230k and my agent said offer 270k I think shes out for her self.

It would not be your agents interest to not submit your offer. If you low balled it is not uncommon not to receive a counter offer, the seller just doesn't want to waste time ****ing around.

You can request a copy of the signed rejection. There is a form for the sellers to sign for the refusal, it simply is usually only conveyed verbally.

It is common in my area for rejections to be done verbally, especially if it was a lower offer. Why wouldn't your agent send the offer over? That makes no sense, Realtors don't get paid unless they sell, so not sending an offer just doesn't happen.

What you are describing happens often (especially REOs), the seller straight out rejects and tells the buyer to make their best offer. You can request a written rejection, but you may not get it (again, especially an REO).

Of course people are out to make a buck, aren't you? This is why your theory of your agent not submitting the offer makes no sense. However, the difference in commission between a few thousand dollars is not enough to jeopardize losing referrals.

If you want to call the listing agent, go ahead, hopefully that will put this conspiracy theory to rest for you.

In my area we now have a form that has sellers verify that indeed yes they have seen the offer that is so low that they don't even want to fart around with it. There is no requirement for them to sign it - it is a courtesy to the buyers.

I like it. The more openness the better as far as I am concerned. I am tired unto death of people thinking that their poor offer must be responded to. It doesn't. Sellers can just chuck it. There is no advantage to the buyers agent in not submitting an offer and there is no advantage to the seller in messing around with people who aren't serious.

Landlord is right. It is extremely unlikely that your agent did not submit your offer. Whether you low-balled or not, the seller did not like your offer and it was the seller's choice to verbally reject it. From here, it is up to you if you wish to submit a better offer. Rather than fighting or distrusting your Realtor, seek his/her advice if you still want the property so you can write a more acceptable offer to both you and the seller.

The only way your agent will get paid is if the house sells,
the only way it will sell will be if the offer is accepted,
the only way the offer will be accepted is if it is submitted. Therefore It would be safe to say the offer was submitted, because I am sure your Realtor wants to be paid. They seller just didn't want to counter it, it's a free world. Re counter and see what happens. The sellers agent owes you NOTHING.

ADD: There is NO counter offer, what are you expect a signed sheet of paper with NO written in BIG LETTERS?

I think this is an excellent question that places the entire sales process in question. Ultimately I believe trust does come into play (but with a lot of money at stake who can you trust?)
One respondent said "ask for a written counter-offer" which did make sense but I wonder if this typically occurs and if it is a bon fide document.
I'm going through the same process myself and HAVE HAD 3 "FINAL OFFERS" (each a bit lower) in 2 days from the same buyer...obviously something stinks.
What can you lose by asking for a written counter-offer?

Usually the seller would have a counter offer for what they want to sell at. Ask for the counter offer in writing from your agent.

In my market, there’s no such thing as a written rejection. You either get a counter offer or a verbal rejection.

Edit: fire your agent if (s)he didn’t ask for a counter offer. The agent I work with ALWAYS does this, even when an offer is outright rejected. His strategy is to ask for a list price counter so that negotiations can continue. Even if they refused at least he tried.

You can ask the seller's agent but they may not want to put anything in writing. Plead ignorance, saying you hadn't heard what had happened with your offer. They would let you know if an offer was submitted. Of course, they may get back to your agent and ask why he wasn't talking to you but do you really care? It is your money.

You may want to tell your agent to start looking for other properties in your price range. He may do that, or, if he was being deceitful and just trying to get the biggest commission out of you ("make the highest offer we can" sounds like he knows what you can afford and wants to push up the price), he might try to negotiate with the other agent.

Interest rates aren't bad right now - 6.25% yesterday at our credit union - so lock in on a good rate if you can. That will effect how much house you can afford. But do not max yourself out. Taxes, added levies, and insurance invarably are more than they estimate.
