My mother passed away in August of 2007. I am administrator of her estate. I am also sole heir. I want the home, however there are two mortgages on the home. I want to pay off the 2nd ($20,000) and re-fi the 1st with a down payment of $30,000. The loans total $104,000. I could pay off the whole loan but there is not much sense in that in my opinion.
What I want to know is how do I go about purchasing this home when I am not only the seller but also the buyer. The estate is insolvent and I want to either buy the home or refinance the home, whichever is easier. The money spent will turn out to be the same either way because her debts will be paid off (contingent on me claiming this asset, otherwise it's easier to cut loose and finally begin the healing process).
So how do I write hardship letter when I want to personally cure this situation? Additional Details Yes, I am going to consult my lawyer tomorrow. I was just asking this for a little insight. Just so I can trust what my lawyer says. I have already had a difference of opinion with him regarding another issue and it turned out I was right. Maybe the cure is a new lawyer but I shall see. |

Previous posters are correct - this is best left to a lawyer...
But...
One poster told you to do a quit claim. DO NOT LISTEN TO THAT POSTER!!! You have a fiduciary duty to the estate. Giving yourself the property of the estate while ignoring other debts - which is what you're doing when you quit claim - violates that duty and is probably criminal.
You probably realized that already, and you're probably using Yahoo Answers to help you know what questions to ask your attorney, and you probably know to take any advice given here as you would any advice from a complete stranger (check it out with another source before you act on the advice).

You can't refinance because the original loan was not in your name. Now....here's a issue....the home will be re-valuated and you will be taxed on the new value. So you may want to rethink just paying the house off, homesteading in your name and go forward like that if you can. Then later on if you want to finance part of it, the taxable value won't change. |

You should be able to refi the loans since you are the heir of the estate. You may need to do a quit claim to get your name on the property, but the refi is your best course of action and the easiest to do when financing. |

I am confused about the "fiduciary responsibility to the estate" comment. It seems that you indicate the bills will be taken care of and you are going to purchase the house, being the sole heir, this shouldn't be challenging.
The hardest part will be how to transfer title in the most financially responsible method. You don't want to pay inheritance tax, transfer tax and set yourself for a huge capital gains hit if you do this incorrectly.
I agree that an attorney should advise you, but you may also want to talk with your accountant about how to avoid tax ramifications.
Sorry about your loss and best of luck to you in 2008. May the grieving process be swift once you can devote yourself to it and not settling the estate. |

You want the home. I know that because you said it. You also want to pay off the second mortgage. I know that because you said that too. Refinancing might be a good idea because rates are pretty good right now. On the other hand, you want the home and you can just pay it off. Easiest thing? Pay it off and enjoy the home. |

You need to seek out the advice of a lawyer who specializes in this matter. If you seek the help of yahoo answers, that is great, but you might find financial repercusions later. I don't know where you live, but there is a company out that might at least be a sounding board and perhaps refer you to someone in your area.
I am so sorry about the loss of your mom. I lost my mom when I was 21, so I understand the need to get through the healing process. I think an attorney could really help you right now, so you don't make mistake during the grieving process.
