Can I ask my landlord to just use my deposit as my rent if I'm late??
Moved into apt. in Feb. of '06...paid one month's security and first month's rent. From June '06 to August of '06 I had 2 evictions filed against me from them due to my mom(who was staying with me & had agreed to pay the rent) not paying them all of the rent. Since then though, I've always paid them, not on time, but they have always accepted partial in the first 2 wks. & then the rest at the end of the month, between the 20th-27th. They have accepted this ever since August of '06. Now this month, I had surgery and i had to pay for that, so I was only able to give them $160 on the 16th of August. I still owe them $364. I'm still not home, but my neighbor who checks my mail said that I received letter from them, stating that if I do not pay them the full amount by this Friday, August 24th, they will file papers. Can they just use my security deposit to pay the rent due? I was in a year lease w/ them lst year, now I'm mnth-to-mnth.
Additional Details
Last year, when I had the 2 evictions filed, I never went to court for them b/c I paid them b4 we could go, so they dropped it...but they told me last year(when I was under the year lease) that if they had to file papers again, they would evict me for sure, and I'd have to leave.

Do they know you are in the hospital? You should call them and tell them where you are and when you will get out. Then they 'may' be able to be patient for a bit. Most landlords cant use the deposit as rent- by law it must be kept in a special savings account until the person moves out. You may be able to get help thru the social services (welfare) ask the social worker thru your hospital to get you the paperwork- because you are in hospital you would have a good chance to get some help with the rent or they can refer you to a different agency that can help.

You could try talking to your Landlords about your situation. Being that you have never paid on time is why they are threatening with eviction again. But honesty goes along way. As far as your deposit being used as rent...I do not think they will allow this because once you do move out they need to be covered in case there are any damages to the home. I would just call them up...they are human and understand that emergencies happen.

No, that is not the purpose of a security deposit. The deposit is made so that landlords have the ability to recoup any loss from damage or theft.

I really don't think so. And sounds like you're on thin ice with them so they're just going to be looking for a reason to evict you.

I don't think they well use your deposit but you can call they and tell them what going on and see if they well. There are Church's out there that can help you with your rent if you are in need and going to be evicted.

You can ASK but they are under no obligation to do that and I doubt they will I certainly wouldn't. Security deposit isn't for rent, its for security for any damages a tenant may have caused. If/when the lanldlord evicts you, the security deposit will be applied to any damages and then to unpaid rent/fees.

And while GC spoke a bit roughly he is on the mark. Its not the landlord's problem WHY your rent wasn't paid/paid on time. He doesn't care WHY, he just wants the rent paid and paid on time. If he has to constantly remind you to pay the rent and constantly accept partial payments (ie late rent) there is going to be little or no sympathy/understanding when you have a genuine problem (like surgery)

Since they told you before that if they had to file papers they would follow through it would appear your only options are to either pay the $364 by Fri Aug 24 or be evicted

If it was me, even if you paid the full amount by Aug 24 (and here I assuming your month to month is 1st to last day of the month) I would send you notice before Sep 1 that your lease is not being renewed and to vacate the premises by Sep 30 (ie 30 days notice) I would rather have an apartment empty than have to continually babysit a tenant to get my rent and even then constantly behind.

You've done 'wear and tear' to the apartment. On a normal person that pays his rent on time and in full, this crap is covered... Security deposits don't really cover all of that.

You've been a PITA for the landlord or rent collector.

I had tenants like you two times. Glad to get rid of you, just please don't trash the place on yur way out. And please don't leave puppies in the house when you leave.. had to have the last one put down because of all the infections/flea bites/whatever.. Jackasses just forgot it.

Honey you need to give it up and move. You aren't able to pay that kind of money for rent and need to find something within your means. You might as well consider your deposit used at this point. But don't wait, just move and get the headaches over with.

Maybe you could get some assistance form the county you live in. I know you don't want to consider that, but each of us needs help from time to time.

Just so you know security and or damage deposits are not rent payments. They are two different things. Sounds like you need to go back to finance 101 to bring up your grades some!?

Security deposit is assigned to escrow, designated for the purpose of liability and damage collections related to the property. They would have to be pretty cool to agree to it, and they probably just want to get rid of you. :)
