Can I be sued for past rent and damages for a home that my mother was buying when she passed away?
My Mother was buying a mobile home from a private seller when she passed away in March. she is still legally married to my stepfather but he is incarcerated. My younger brother lived there for the past 3 years and does not want the house either. I am not on any paper work for this home, The owner has called me and says he is going to take legal action against me for past rent and damages. Can this happen since I am not tied to this property and My step father is legally next of kin?

You yourself are not legally responsible. However your mothers' assets may have a lean put against it if she signed an agreement or lease. Check to see if your step father and/or brother signed anything as they may be responsible. Check the lease first.

Nope! If your name is not on the lease or rental agreement, and you yourself did not live in the mobile home, then you are not legally responsible unless your younger brother is a minor who is legally under your care. Tell the landlord you'll take your day in court. Without legal documents, he has no case.

Not you personally, but they can sue your mother's estate for the money. For example if she owed say $4,000 and she had a life insurance policy, they could sue for that money, or if she left you a property, etc. Again, HER estate. But you personally are not liable for her debt.

You can't be held liable for this. Tell the owner that is hassling you to take a hike. If only your mother's name was on the agreement than only her and any estate she left behind can be held liable for the monies due. The owner could certainly sue her estate (if she had any assets) for money owed. Your brother might have to pay for any rent owed while he lived there after your mother passed away but as long as he is not on any of the paperwork he will not be liable either. Did she have a will? Did she name anyone the executor of the estate? The next of kin or the executor may have to deal with legal issues but the owner can only go after assets that were in her name. Hope this helps!

They take legal action against the estate of your mother, not any living person. The executor should sell the property and divide the profits among the heirs. Either that or merely surrender it to the creditor. If she had any other property or assets the executor of the estate should use them to satify any shortfall. The life insurance is NOT part of that amount.

The only way that you would have to pay for anything is if you were the person responsible for her estate when she passed. In that case, he would sue her estate and not you personally. If that is not the case, then you shouldn't have anything to worry about. This is a typical strategy to get money when they don't have any legal means. They use scare tactic. I would call an attorney in your area just to be safe though. they typically don't charge to just ask questions.

He has no legal grounds to come after you. His best bet is to sell the place and be done with it. And yes, your father if he was legally married to your mom at the time of her death, will most likely be legally liable.

If I understand your problem correctly, Your Mother should still be the owner thus the previous owner is not due any rent. If the mortgage is not being paid then it is up to the previous owner to forclose on the property so he can sell it again. Of course the recall would go against your mothers husband and/or the exectutor of the will bepending on what state your in. The right thing to do of course is to ask your step father what he would like to do with the property and then if he is ok with letting the property go back, then every one should move out of the property as soon as possible and turn the property back over to the privious owner. Always put what you do in writing and you might contact a real estate attorney in your area. Something like this, you might even get the info you need for free.
