Rachel S | Can I break a contract with the realtor if he is at fault? |
I have my house listed with a realtor and in contract. I have done all the work other than he placed the sign in my yard and 10 minutes of paperwork. I even took the pictures for the MLS.
We ended up buying a house through another agent while ours was on the market. Reason: he refused to show us the house because it was not his listing.
He then retaliated by not telling us when the inspection on the home we were selling was (he did know when). I almost lost the deal because of that.
He then went on to call my mortgage broker (has nothing to do with the home that we are selling)!
He has not helped us with anything~ not to mention, I showed the home to the people who are buying it. What can I do? Thank you! |

First and foremost...you need to contact his Broker immediately. Sounds like he is acting very unethical, especially the part where he refused to show you a home. To his defense, realtors do a ton of work behind the scenes so just because you don't see him working, chances are he is doing work that you don't see. That doesn't excuse his behavior regarding not disclosing when the inspection was scheduled. As for him contacting your mortgage broker, he is being nosy and you need to let your mortgage guy know not to disclose anything to him as he isn't representing you in your purchase. Keep your head up! It will get better! |

Good news: You owe him a commission if your house has sold...regardless of how little he did for it.
Be sure your mortgage broker didn't tell him anything about your deal....it is illegal for him to do that unless you give him permission.
Better news: He wasn't your buying agent and you had ever right to buy a home through another Realtor.
Advice: Report him to both his Broker-in-Charge and to the Board of Realtors...he did nothing illegal but he is activing unethically...which means he won't lose his license to protect real estate but if he loses his Realtor affiliation he no longer has access to the MLS, which will essentially put you out of business. |

Call him and tell him that you found out that he contacted your broker and failed to inform you of the inspection date. Tell him that you are very upset and disappointed in his lack of professionalism and ethics and you are requesting that he immediately cancel the contract without you owing him a commission. If he gives you any issues, you immediately contact his broker and ask to see him/her in person and express your issues. Maybe the broker will either cancel the listing agreement or assign it to another agent in the office.
I am a broker and I would like to know if any of my agents acted like this and if I thought that my agent was out of place, I would assign the listing to someone else or even cancel it because I would hate to have someone bad mouthing my brokerage. |

real estate laws vary from state to state and country to country. Read you contract and try to find something the violated. If you can inform him that you believe he broke his contract and you won't be giving him his commission. If he put you in touch with the people who bought your home then he is probably entitled to the commission and will likely sue you. |

I would contact another realtor not someone in the same company though.. Let them know what is going on with your current realtor and find out what you can do by law, another realtor can tell you the rules and boundaries for realtors.. Then contact a lawyer and/or fire him and hire a new realtor, because they kinda work for you don't they. |

Well if you already have a contract on the house it may be too late. But you can break a contract with a realtor by writing him a letter stating that you don't feel they are doing the job they were hired to do. I did this as executor of my dad's estate with his home. I listed it with an agent and in a month never had one looker. So I fired them. So yes it can be done but timing is everything. |

Honestly it all depends on what is in your contract with them.
You should have it spelled out in the contract the responsiblities of each party involved. Then when someone doesnt do something you have a leg to stand on.
Review your contract and see what it says. |
