Can I break my lease if my Landlord will not get rid of Bugs... Please read!?
I just moved in to a new and nice apartment in February. I am a very clean person and I have never had bugs in any house that I have ever lived in... I called them twice and went to the office twice! They still have not had anyone come out! I have a dog, who is my everything. She started having a rash on her back that turned into really bad scabs and her eyes started having puss come out! So i took her to the Vet it was an allergic reaction to a spider bite! Now I have a sick dog, a $200.00 Vet bill and bugs... My question is can I break my lease? This is nasty and I cannot live like this! I do not know what to do! If I break my lease can they sue me? What steps should I take?

I pay $715 a month for an apartment... I do not have proof that I went in there... MAYBE a phone bill to show that I called. I think I will go in AGAIN and send them Certified mail...

You can't sue because your dog is allergic to spiders. You would have a tough time with a kid, but impossible over an animal.

The landlord has to spray every 2 months, outside only, if there are insect problems.

Invest in some Raid.

You can not break your lease over this.

NO, you cannot break the lease (at this point) without having possible legal consequences. You say you told them and you have gone to the office BUT can you prove that in a court of law?

If you want to protect yourself in case you want to try to break the lease, you need to send a letter to the landlord by certified mail with a return receipt documenting your concern and giving them a reasonable date (ie 10 business days) to treat the apartment.

You can't break a lease because your dog got bit by a spider! It's unfortunate that he turned out to be allergic to spiders, but he could have gotten that bite anywhere, not just in your apartment.

You say you have a "bug" problem in your house. Are you talking only about the spiders? Or are there other insects, such as roaches? Have you tried putting any poison or natural repellents around in the places you find these bugs? Has the landlord said anything to you about your complaints? Is the apartment building sprayed on a regular schedule?

I doubt very seriously whether having bugs is grounds for breaking the lease, unless it's such a severe infestation that the apartment is actually a health hazard (to *humans*). If you really think it's bad enough, call your local board of health and see if they'll send out an inspector. That will give you some real ammunition when you talk to the landlord again.

Depending on where you live and the lease you signed will determine the consequences of breaking your lease as well as what they are required to do as far as pest control.

If pest control is specifically addresses it is assumed the tennant will be responsible for inside insects.

Im sorry your pet had to suffer, but there is no way you can prove it is from the bugs in the apt.

They can sue you for the remainder of your lease, some do and some don't. Chances are they won't if they keep their property in such disrepair.

Write them a letter and send it certified mail that they have 10 days to have an exterminator spray your apt as well as those around you, empty apts breed bugs. If they do not, you are giving them your 30 day notice that you will be moving out. Then send it certified with signature required. That way you will have documentation should it ever come up with a different landlord.

Then move. Don't expect a return of your deposit, and do expect a letter from them stating that breaking the lease results in you owing them ???? amount.

you need to call the health department and report it first, wait to see if anything is done.... if not, then just pack your things and leave. If they try to sue you, you have documentation proving that you had to get Dept. of Health involved cause of the disgusting, bug infested conditions that your landlord had you living in. as far as the VET bill is concerned, you got to eat it. unless you can find the spider and prove that THAT was the spider that bit your pooch and that the spider had been living in the house prior to the incedent.... so forth and so-on. whos to say he didnt get bit at the dog park or outside in your backyard or sidewalk?

This is a clear default by the owner.Read your lease it should have something in it about default by owner or resident.Bugs INSIDE are the responsibility of the owner too,not just the ones outside.We spray each and every month ,inside the apartments and we do not have any bug problem.
Yes the owner should be held responsible for the vet bill because it is their responsibility to do everything possible to keep your home bug free.
Put your bug complaints in writing and mail,certified mail, to the owner or manager. Get in touch with the local health department because you are paying good money to basically live in a fancy ghetto.
Yes you can break your lease over this.Document everything,pictures are great and they may attempt to sue you but with the bug evidence,I doubt they are going to want that all over court.
You deserve to live in a bug free home,no one should have t live like this.
DO what you have to do to get out of this situation.
Why should you be giving them money when they are not fulfilling their obligations as owners? They are in default of every lease I have ever come across.
And for the lady who thinks that landlords and owners are not responsible for bugs inside the property,you are mistaken.

call the office and ask when their coming over to spray, tell them if u dont get a definite date than ur going to call housing authorities. they will get over there asap to avoid housing fines.

you could break your lease. you could even sue for them not getting rid of the bugs and they would have to pay for the vet bill.

i think you should set up a date with a judge and sue this meaner!!
