Can I break the lease?
I just rent a room of a house on the september first aand singed 1-year lease. After I moved in, I found the room has a bad odor. I guess the odor is caused by mold. The bad odor cause nasal congestion on me. I talked to the landlord, but he just ingore my complaints.

Can I break the lease early?

I don't know about laws in your state, but in Indiana, you can take the landlord to court to break the lease - if it is for unsafe living conditions. Otherwise, in Indiana, most laws pretty much say that if you continue to pay rent, you are accepting the conditions.

You can do a little research, however. Sometimes odors can be from a number of sources, including what other people are doing in their rented rooms. It could simply be the carpet need shampooing (you can rent one, ask your landlord first though).

If you decide to contact the health department, you could be in for a rough year - and don't expect the lease to be renewed. This may or may not get you out of your lease - the landlord may just be required to fix the problem if one if found in a given time frame. You will have to be sure that it is mold causing the odor and that your nasal congestion is caused by the mold - and not fall allergies or dust mites or a previous tenants pet birdies. Your room also must be clean if they decide to inspect it.

Leases are broken every day. But, if you do break the lease, you will pay for it. Don't do it. Instead, talk to the landlord. I don't think he is ignoring you. Good landlords, like myself, care about their tenants. We want long term tenants. I'd write a letter addressing the concerns. My bet is that he will do something about it. Good luck!

Don't just talk to your landlord, write and mail return receipt letters. Keep a copy of the letter with the receipt so that you have proof you notified your landlord. Always put requests in writing. If you have mold. . .you can see it. . .then notify your health department. They will send someone out and deal with your landlord about the mold. But if the apartment is just dirty, they will not be happy with you. Look around and see if you can find any leaks or where damage has been done to the apartment. If walls get wet, the mold can grow on the inside of the walls. Also do you change your filters in your a/c? Shampoo the rugs? If you thoroughly clean your apartment and then still have odors, call the health department. Be careful about making false claims.

What does the laws of your state say about odors? The laws of your state on this issue will be the deciding factor.

If you go to court, be prepared to prove it is the odor in the house and not some other source that is causing your nasal congestion.

You can always break a lease, but it will cost you money. I doubt your smelling mold unless you also see mold. Maybe the carpet just needs a good cleaning.

Did you wash your feet? Do you know what mold smells like? Could it be a ham sandwich left in the closet by the last renter?

You can break the lease, but you'll pay a penalty. Ask the landlord how much.

Give your landlord a written notice asking him to correct the mold problem or release you from the lease.

If he ignores it, you may want to talk to your county health dept.

Go to your local city hall and get a copy of "renters rights". Im not sure what it's called, but if you ask Im sure they'll know what your talking about. Mold is a very toxic substance and not to mention a health hazard. Carefully read your lease. I would definitly think there is a way for you to break it and not be held responsibly due to the living conditions. I have broken about 4 leases due to moving, family illness, and not having my toilet and fridge fixed that was molding too, so dont think your going to be "stuck" into that, and I damn sure dont think you will have to pay.

Call the health department.They will either make the landlord fix it or give you the reason you need to leagally break the lease if there is something wrong.
