yfashionista007 | Can I buy a home after Bankruptcy with no savings? |
In June 2007 I declared Chapter 13 bankruptcy. Since I'm paying a whopping $975/month to my trustee plan, I have no way to save money to buy a home for the next 4 years. I'm wondering if there is any way that I can buy a home with no savings? |

No, and why would you under this circumstance. You need to wait until your bankruptcy clears and save money. Otherwise you will be filing bankruptcy again. |

Sigh...unfortunately no.
Your credit report now has a big ugly stamp on it that no loan officer will ignore. Even if they could get past that, the amount you pay per month for your bankruptcy will greatly affect what you are able to pay for a mortgage. I would focus solely on paying off the bankruptcy first and try to establish some form of positive credit before applying for loans. The hard inquiries are only going to hurt you. |

If no savings, you'll need to wait 2 years after the discharge date and make sure your credit is perfect during those 2 years. Also make sure you have at least 5 open tradelines IMMEDIATELY so they all have a 24 month history by the time you're ready to buy. |

You actually can buy a house while in Chapter 13 & it is not with a sub-prime loan. However, the courts have to approve it. If you are strapped with the payment for the BR I don't know how you think you can buy a house. It is doubtful you would qualify. A Chapter 13 is a much better way to go than a 7, but it still has repercussions. Save some money & learn from your mistakes. If you learn then all was not in vain. |

You should probably wait a little bit, but if you are able to pay more than $975 a month to the trustee plan and pay it off earlier than do that. It's harder to get a loan right now because of the sub-prime thing, and also because you have a huge chunk of your paycheck already accounted for. Although your credit may be lower from the bankruptcy, you should try and increase your credit score. Then when you are done with the plan, you can save up for a little longer and have a sizable downpayment saved up. |

Probably not with a current chapter 13. Check with a lender and see if there are options for you. That's the first step. Anything can happen. Don't give up. |

no. But you can start correcting your credit, and you should be working closely with your banker to do so. Once you have cleared enough on your credit score, you may be elligible for a home loan, just remember that banks cannot loan you anything that will put your payments in excess of 40% of your gross monthly income, and if your trustee plan is anything over 15% of your GCI, you will likely not get a loan. |

Most lenders have stringent requirements for lending to former bankrupts. The lender I worked for previously required 2 years since declaration, and it must be discharged before the loan process starts. The one I work for now is much more rigid. We don't, unless you have a previous relationship that overrides the BK. In addition, the reason must have been out of your control (specifically, divorce and loss of business/employment are not acceptable reasons -- pretty much somebody had to get sick or die), no slow pays or missed payments on any account since the discharge which must be at least 2 years ago. |
