Can I deny entry to my landlord?
My wife and I are renting a house that is going into foreclosure. The owner has given us 30 days to vacate, but has extended the notice until Dec. 1. The owner contacted us by email last week and said he wants to come to the house on Nov. 22nd to remove property that he says belongs to him. (i.e. appliances, window coverings, etc.) We are still using the stuff he wants to remove. How do I prevent him from coming in and taking things that we are still using?

I have read through the lease and it does not state anywhere in the agreement that any property is "not included". So it is my understanding that everything within the property line is included with the rent. Am I reading it correctly?

Call your local housing authority, they can give you a list of what he can not take per your counties housing laws.

It is unlikely he can take anything prior to 12/1. Landlords have the right to inspect their property, not remove it after it has been rented.

If the stuff is included as part of an appliances furnished lease he can not have them If the place wasn't appliance included or there is no lease no you must let him take them. Sorry to hear about your misfortune.

well, legally you have no right to deny him access since he does own the property and has given you notice of his intent to enter the residence. That being said, ultimately his abilities are determined by your lease agreement and the applicable state laws.

In this situation, you shouldn't. Since you're renting those things, and don't OWN that stuff. He could easily get a court order to make you let him in, and they might even be able to send a police escort with him. Just let him in to take his things, and next time, try not to rent a house these days! They're ALL going into foreclosure. Good luck.

Sounds like he could have ordered you out by Nov. 22nd but extended the date even though he didn't have to. Be thankful you have a place to stay and hope you can find a place to live in by Dec 1st. If you don't allow him entry it will be at least another week before he can get a court order and have the sheriff come and make you vacate the property. Be careful though, it sounds like you are dealing with someone who is acting out of desperation.

Read your lease carefully. If the lease stipulates that you had rented the place with all the things in it, you can tell him he would be in breach of the contract, and that he should do it after you moved out. If he does not abide by your request (if you have the right under the lease), change the lock of the house by calling a locksmith. If the landlord complains, you tell him that he was in breach of contract and that you will give him the new key upon you vacating the place. The locksmith usually charges starting $100 to change the lock. Shop around to find out before calling the locksmith. The price varies so make sure you agree on the price before he gets there.

go to the local tenant union or city building and find out what your rights are. Usually when the building is in foreclosure theres nothing you can do and you were lucky they even gave you 30 days. Depending on where you live, the landlord has the right to come and go as they please

Removing anything necessary for your habitation is a "constructive eviction" and will result in your receiving compensation in the form of a rental abatement for the time you were unable to live there (i.e., the day he comes to remove things you're using).

Depending upon your state laws, the landlord has to evict you properly through the courts or the foreclosure has to be postponed (which isn't your problem). You don't care who owns the property; you're just renting the house for a limited time and paying rent to whomever is the current owner. The eviction is a separate problem.

Also, depending upon your lease, you are under no obligation to let the landlord into your premises at ANY TIME. If there is an emergency, they might "break in" and then raise that as a defense to trespassing on your premises. However, in some states the criminal trespass statute does not apply where there is a "contractual relationship" like yours. Maybe if we knew what state you're in we could help more.

He has given you your 30 day notice and shouldn't be allowed to remove anything until that time is up. He does have the right to inspect only if he gives you enough notice. If you change the locks, you must give a landlord a key to get in to the place in case of an emergency. Go down to your local municipal building or courthouse and pick up the booklets for landlord and tenants rights. You can also appeal this in a court of law and that would be tenant-landlord court. Make sure that the landlord gave you everything in writing as a landlord must obey the law too. Good luck. I know these things because my sister and husband are landlords to apartments and houses for many years. I also help write letters for them and live in an apartment too. Check your original lease too and any addendums, so you are informed and not caught off guard.

You are using his owned items. Would you like to lend your items to someone, and try to get them back and they tell you no...I'm still using them?

It's still his property, so you can't deny access to the lord of the land aka landlord.

If he rented it including the appliances I would think he would be in violation of the lease. The thing with that is by the time you sue to keep them he will already be in possession of them, and he would then only be required to pay court cost, plus 8 day rental of his own appliances.

As far as window coverings 8 days is not too long to have to have to put up temp curtains.
While it may not sound like I am not on your side, I am. I also know they won't really care, especially considering he gave you an extension to vacate which I'm guessing he didn't have to do.

Perhaps you can ask that he at least leave the stove, refer, etc,,, items needed until the 29th of the month. That way at least you'll still have everything for the holiday.

He can't touch anything until he honors your lease or repays your money. He has leased the property with the appliances as part of his agreement so he can't remove them until your lease is up.

It all depends on what the landlord and tenants act in your area allows.

Your best bet is to call Landlord and Tenants and ask them what to do.

Anything else could set you up for a lawsuit if it's not within your rights.
