Can I get evicted for a messy apartment?
My landlord called me today that he will be showing my apartment, but I am out of town. I have some dirty pots and pans and some dishes I left. My bathroom is generally clean but my bedroom I don't have the bed made and have clothes everywhere. People tease me that I have a messy place and though I know it's true and should clean it before a showing, it isn't a "disgusting" mess.... just messy with school papers, bills, and clothes.

I am unable to go to clean it before his showing today as I'm coming back tomorrow... could he evict me for a messy place?

Why is your landlord even showing your apartment?

Are you planning to move out?

Unless your landlord is planning to rent your apartment to someone else because you will be moving out, he should not even be showing your apartment.

I know, I am a landlord.

It really depends on what your lease says, but probably not unless your mess is causing health issues like attracting bugs.

Answers one and two are both correct. Also if there is a public health or safety issue involved with your mess. Other wise your lifestyle is your business as long as it is contained in your living space as defined by your rental agreement. If he has to haul anything away (ie. garbage outside in public view) you can be charged.

no the only way that your landlord cand evict you if there is any damange to the apartment or if you have not been paying your rent on time the way your apartment looks does not effect his property so he has no real grounds for an enviction

Well, given all that you have sad, he may be perturbed by the way you keep your apartment, but he would not evict you now even if he could, because since you are leaving in December, he couldn't file papers in court and actually get you out before then. He wouldn't waste his money or his time. I would suggest , however, that you at least try to clean house a little before going out of town; not even rinsed dishes are good enough. They really should be cleaned, the trash should be taken out. It is just more sanitary.

Gross - you left pots and pans out to start molding and attracting bugs. Especially when you're aware that your place could be shown.

Can't get eviceted for general messiness just if it's a health or fire hazard.

You should take extra care on keeping the place picked up and clean while it's being shown even if you don't have any showing scheduled. Case in point - you aren't in town and they're showing it today. Who wants to rent an apartment or house that is so messy it could be unhealthy or unsanitary.

A landlord can evict you just because.
if you have a friend close by, ask them to pick up your room, make your bed and do the dishes.
this should be a lesson to you. never go out of town before the work is done. there's no excuse to leave dirty dishes in the sink if your not going to be there.

No. You're paying rent for your use of the apartment. As long as its not attracting rats or damaging the apartment, then nothing can be done to you. Why is he showing your apartment anyway unless you're leaving soon?

Its his fault for not making you aware in enough time that he'd like to show the apartment.
