Can I get this dead-beat Tenant to EVER leave???
I know everyone is going to think I am crazy, but in our first attempt at renting out an apartment we seem to have gotten the tenant from Hell. We agreed to let her move in with 1 dog and 2 cats. She promptly moved in with 1 dog and 11 cats. Her apartment rent was being subsidized by a local charity group, so the first months rent and security were paid. However, after finding out about the unauthorized animals we asked her to remove them and she refused. The charity pulled their funding because she was unwilling to follow our rental contract. We gave her a date of eviction as of Sept. 1st. She has presently planted herself in the apartment, not paying any rent and still has 12 animals in this 900 sq. ft. apartment. She has let us know that she is there and there is nothing we can do about it. We have contacted a lawyer and are having her served with eviction papers, but is there a chance the court will rule she can stay???

A couple of idiots have suggested you cut the power. Don't even THINK of doing that -- it could get YOU arrested!

Carry forward with the eviction proceedings with the courts. These are fast-tracked and you should have her out in about a month or so.

no court will side with someone who is violating the terms of the lease and not paying rent. want to make her life hell so she will go? knock on her door morning, noon and night seeking rent. u are legally within ur right to keep bothering her to seek payment. call aspca and let them know how many animals she is harboring, she will so fed up with the aggrivation of ur collections its not worth it for her to stay. make her life hell.

ABSOLUTELY NOT. You have nothing to worry about, once you get in court the judge will rule on your favor and give her a date to be out by, if she is not out by that date then you contact your lawyer who will then contact your local sherriff's office and set a date to have her physically removed from the property. The sherriff will come out and supervise to make sure no scene is made, you arrange to have someone carry all her items to the curb and change locks, problem solved. Good luck and be prepared to change carpet in apartment!

No chance! Even if she's on a six month or longer lease, she has breached the contract by having too many animals.

Goodbye tenant from hell.

Go to landlord tenant court and apply to have her evicted for breach of contract (have witnesses if you don't have in writing the number of animals allowed in the home). Tell them that her continued occupancy is detrimental to the overall value of your home because of the animal presence.

She has no chance in court.

Just be sure you don't allow your anger and frustration to do or say something that might be used against you. My policy is once I turn something over to the lawyer, all communication must be through the lawyer, if they call you just say "you need to speak with my lawyer" and hang up the phone.

In the meantime, document everything dates times incidents anything that might be useful for you in court.

Consider checking into your local ordinances on the number of pets someone can legally have in this size dwelling. Maybe a visit from the animal police threatening to remove some of her cats will get her to move out faster than waiting for the judge to evict her.

Eviction is Eviction.. I would think that when the police arrive, she will re-think her stand. Be sure and let your lawyer know that animal control might want to arrive at the same time. She most likely will not have proper carriers to transport the animals.

No, the court will side with you. The sheriff will escort her out of the house. It just may take some time to get through the court system. :(
Take her sorry self BACK to court and get her wages garnished for the rent she owes you and for the damages I'm sure her animals have caused.

As long as you give her proper notice and have proof that she has broken your ageement. You are fine.
Once you have served her with an eviction she has to be out, Depending on your state you can then go into the apratment and remove her belongings and put them outside(depending on your state laws), or in a storage unit.
The court should not rule in her favor just make sure you have well documented proof.
Start keeping a communications log , all it needs to have is the date the conversation and initials at the end of the sentence. So they know who wrote what and when.
Write down everything, this will hold up in court because yu will be able to prove your case.

No, but in the meantime, and that could be long, you'll be not making any money and paying your lawyer (BOO!). Don't you like cats better than lawyers? Then you'll have to pay the Sherriff to go kick her out. She may cause unseen damage to the place out of spite. Cats aren't so bad, when charitable organizations are paying on time and you don't have what you are about to have going on!
