Can I hold the apartment complex liable for theft when they knew there was a problem and did nothing?
Our motorcycle was stolen and the apartment complex was aware that there thefts going on inside the complex. We had gone to them before saying there had been attempts to steal our cars before, and they did nothing. We took as much precaution as we could, but it was not enough. Can I hold them liable because they knew there was a serious problem and did nothing to protect us as renters?

No, they are not liable. You need to contact your insurance company.

This is a police and insurance matter, your landlord is not involved in any way.

No you cannot hold them legally responsible for your personal property, that is what insurance is for.

Tim S
It's not their responsibility, sorry.

Just knowing that there have been many thefts doesn't make them responsible.

If they were aware of a specific vulnerability, like an inadequate or broken lock, and did nothing to fix it, you could hold them responsible. Or try, anyway.

They are not obligated to protect your property so I would say no. You cannot hold them legally responsible.

Won't your insurance cover it?

I doubt they would be held liable. You will spend more money on a lawyer than it's worth most likely.

acermill
They are not liable for theft of your personal property. Just what DID you expect them to do to prevent such a theft ?

No, they are not responsible for neighborhood crime. What did you expect them to do, spend $$$ to put in a security fence or something? They are not obligated to do anything of the sort.

John B
This is why you pay for insurance call your agent. You may have cause to cancel your lease if this is such a scuzzy neighborhood that gets robbed all the time.

Google landlord tenant laws in your state. Generally if they are aware of a problem and don't take the property precautions they are liable. To what extent? You could probably cancel your lease without any penalty and move out.

Yeah, like utter neglect of giving due process or neglect of the issuance of the proper conducts of law!
