Can I increase my tenants rent with a lease in place?

Only when it expires, which could as often as once a month, with a 30 day notice of the change.

If you have a yearly lease it only raises once a year.

Probably not. The rent is set by the terms of the lease and can not be changed until the lease expires. A new lease then needs to be signed that includes the new rent amount. You also can't terminate the lease without cause. This is a legal contract signed by both of you. As long as the tenant follows the rules set forth in the lease you are legally bound to do so as well. You would do well to inform your tenant well in advance that you intend to increase the rent at the end of the current lease. And again in writing within 90 days of the expiration date.

If it is a term lease (1 yr., etc.), No.

If it is a month to month lease, Maybe.

The basic reason a "tenant" wants a lease. They have a guaranteed amount of rental each month until the lease expires.
This is why a lease is good for one side of the transaction, The tenant.
Unless your lease has a clause of maintenance increases (normal for commercial buildings) Then sorry to say NO. Try looking up tenant/landlord law in the state of Florida.

If there is nothing in the lease that gives the landlord the ability to raise the rent then no you can't raise it until the lease ends and a new lease is signed. You have a contract. The only other option you would have is to start eviction proceedings and hope you win AND that you can find new tenants that will pay the higher rent.

Why do you have to increase the rent? Its happened to me in the past 2 rental homes ive had. Its very hard on the tenant and i don't think landlords stop and think about the person trying to live in the home.
