I don't think legally you can do this, I am not sure why, but I think if you say they can stay with you, you have to go through the eviction process to get them to leave. And even then you have to have a cause for evection.

tnroadwarrior
If they are not on the lease you can kick them to the curb at any time you want to as long as they are not married to you. Be careful though, if they are not on the lease the management company of your residence may have a problem with them having been there.

colorist
Yes, simply call the police and tell them you are having trouble getting someone to leave your home. When they get there just say that they have stayed a night or 2 but don't say they have lived there for 3 months and if they say they have just deny it, the police will escort them off. Best wishes

If the person is not named on the lease, then you as the lessee have the right to do whatever you want within your apartment, including asking roommates to leave.

If they aren't on the lease, make sure your own lease doesn't have a sub-lease clause in it. It might be you are not allowed to have a roommmate living there without the landlord being aware of it. That roommmate you kick out could go to the rental office and stir up trouble to get you kicked out for lease violation. The rental office might decide to evict you for breaking the lease and causing drama.

Yes, and if you feel the need to you should...If your name is on the lease then it speaks for itself!

Good luck!

skigod377
Yes. It is called trespassing and you are entitled to kick them out. You can even call the police and they will escort them out. Sweet, hu?

Of course you can, if the person you live with has not signed a contract then they can leave or be kicked out at any time, without a contract they have no rights

ashley
yes if they are not on the lease then go ahead..

Does the landlord have to be notified of any of this? Because we're having a situation like this and we had someone move in without telling the landlord. And we're going to have to ask him to leave. So could we get him evicted without the landlord being alerted?
