Illinois is not a community property state, so you're fine in that respect. In addition to leaving his name off the title, you need to make sure you get a loan in your name only, using your income only, and funds that are in your name only for the down payment. When you start making monthly payments, also make sure those are made with separate funds. The short version is that if you can prove that he had absolutely no financial contribution to the house and his name is not on the title, you shuld be in the clear. |

From a professional Realtor, if you are purchasing the home yourself, you DO NOT have to put him on title. If you decide later on that you want him on title then you can Quit Claim Deed his name on later. Don't know if you have communtity property laws there, so that would be something that you should check out. Good luck! |

Yes, you can leave his name off from the title. However, you are still married and have both chosen to have this house built and will be moving in as a "couple". Depending on the specific laws of your state this will still give him rights to the property. If it comes down to divorce, the Courts may require you to sell the house and split any monies, or to buy out the other half. Leaving his name off from the house does not guarantee that the house will remain yours should he want to fight the issue. |

If you are purchasing without using his income, I would assume so. But this may still be considered community property in a divorce situation. |
