Can I legally kick my parents out of the house after they have lived in there for over 30 years?
The house is in my name, given to me by my late grandfather. They're paying me rent with no written contract.

They aren't preparing for retirement, there will be a day when they won't be able to work anymore and I don't want to have them in there for free.

Will I be able to kick them out legally?

As you can tell, the way you have described this problem leaves the reader thinking you are a terrible person. But I will assume that you have a good reason for feeling this way, and are not some self absorbed ungrateful brat. Perhaps your parents treated you badly or they are the ones in the wrong here. If not, you should definately rethink your position.

Assuming you have your reasons for doing this, the law would normally go as follows:

without a written contract, most jurisdictions would consider it a month to month lease. to terminate you would give them 30 days notice. If they fail to move out, you would have to go through an eviction process. At that point you will have to appear before a judge and explain your reasoning.

The judge will balance the needs of you and your parents and may grant them an additional period of time to find suitable housing and relocate. But ultimately, if you own the house and they refuse to move, you will be able to get them out. But you sure are going to look like a jerk doing it unless you have a damn good reason.

If you are concerned about that, consider giving them formal notice and lots of advance time to prepare for a move. Document that with certified mail etc.

But in defense of you dude, I am going to guess your parents have been irresponsible for a very long time and that's why your Papa left it to you in the first place....

On second thought, put their old asses out! They gotta grow up sometime. Oh yeah, see if you can get some insurance policies on them. You don't want to be stuck with a $20,000 funeral bill to. It would be worth whatever the premium is. But if you let them stay, get a formal lease written(and NOT from legal zoom.com). And make them also pay Renter's Insurance(cover your *** and theirs). And if they are trife, make um pay it in with the Rent.
