Can I lose my home if my renters do not pay?
I have a home which was occupied with renters. They have stopped making payments to me so I fell behind $10K on my mortgage. I've evicted them and now I am facing foreclosure. I have not contacted the mortgage company as I just found about this-after months.Can I lose my home if the reason is the renters?

I was living outside the US for health reasons. The renters were making payments directly to the mortgage company, which is why I found out too late they were not.

Yep. However, there are many ways to fight off Foreclosure. Such as...if you were not properly served papers by the court...you can have any judgment abstained. You can find out if you have an "open" mortgage or not. If so, you can more than likely do a rate and/or term modification (or Forbearance). There are many things you can do...you just need to start educating yourself on how the whole foreclosure process works...and...if they actually even have the right to foreclose. Its actually very easy to stop foreclosures and sheriff sales. I have done it many times for properties I have purchased in the past through short sale.

Yes this is your obligation, you signed the note it's not the renters responsibility to pay your mortgage but you can file suit against them for the rent. I would try and work something out with the mortgage company on a repayment plan if you want to keep the home.

Sure, it's still your mortgage, your responsibility. You should call your mortgage company and ask about other options that can save you from foreclosure.

Of course you can lose the property. YOU are the one who signed the mortgate documents. YOU are responsible for the monthly payments, regardless of whether the units are occupied or not.

You need to learn that this is a business venture. The lender is NOT responsible for insuring that your expected rents are paid.

Well, here's a question, "why did you allow the renters to stay this long without paying?" I would have evicted them months ago...I would say this is really your fault. Unfortunately, the courts will not take your story into consideration. In fact, I promise they will ask the same question.

there is a little thing called the internet . . . where you can actually review your mortgage account on line each month to see if the mortgage had been paid.

The reason has nothing to do with renters. YOU did not pay, the mortgage contract is yours, not theirs. If you did not honor your agreement they bank will foreclose.

Yes you can. I have a house that is rental property. I do extensive background checks on my renters, and I ask for a security deposit and 1st and last rent. This usually runs around 3,000.00 dollars. If they can't afford that then they can't afford my house. Also the first time they get more than a month behind, start eviction proceedings. You should not have waited. I also have a small savings account I keep just for any problems that may come up including repairs. I have a good rental contract also that they sign. When they don't pay go to justice court and evict them, then garish their wages. You would have their SSN and employer. I have never had a problems.

Try and take some equity out of the home to get caught back up on your payments, and seek the advise of an attorney. Pick better renters next time.

Its potentially even worse that what people are telling you.

If the mortgage on that house is in YOUR name...you will be personally held liable.

Here's what will happen.

The bank forecloses on the home and sells it at auction. The auction won't cover what you to the bank. The bank will promptly turn around and go after whomever is listed on the mortgage. They will claim assets to cover their loss (the difference between what you owe and what they got at auction). So not only will you lose that house and wreck your credit...the bank may come after you to cover their loss!

Moral of the story to all who read...get a liability shield if you own rental property.

i would take the former renters to court to make them pay what they should have if that's possible. if there is a next time always make sure you have the funds yourself in case someone isn't able to pay you rent, but yes, you can lose your place due to not paying your mortgage because it was in your name which makes you responsible.

yes, i would think that you are still at fault according to them. it would have been better if you had collected the funds yourself and made the payments or contacted the mortgage company yourself for receipt of payment. never rely on someone else in these situations. since it is in your name you are still responsible just like when there is a co-signer. maybe you should consult a lawyer to get a clearer understanding if you have something in writing between you and the people that you had evicted, but i would still think you could lose your house.
