Can I renew the lease on my apartment after filing a ch. 7 bankruptcy?
My spouse and I are seriously thinking of filing a chapter 7 bankruptcy for credit card debt. We rent an apartment in a complex. We renew our lease every year. I am concerned that if management learns of my bankruptcy they will not renew my lease. I do not think they perform credit checks with lease renewals because I thought they would need our consent before doing that. I have read through my lease, which is not easily readable, and I did not see anything that states we would not be able to renew the lease due to bankruptcy. Let me also make it clear that we are thinking of filing due to credit card debt. We will be keeping our cars and will continue to pay the payments on them. As well, we will continue to pay our rent. We Live in the state of New York.

It is totally up to the landlord. And even if they don't check credit, they will still learn from the courts.

ignore creditor calls and just make strategic payments; inevitably, in 3-5 yrs, your credit

That is 100% up to your landlord. There is no law that me must renew your lease and no law that he cannot renew your lease. You need to ask him, not us. We cannot make that decisions for him.

I can't imagine they would check your credit to renew your lease. That would be very expensive for them if they did that for every person for every renewal. I've had residents transfer apartments and they've filed for bankruptcy but have excellent rental history.
