I bought a flat in the UK for £150,000 just over a year ago and got a 100% mortgage. I haven't paid any of the mortgage off yet as it's interest only which means I still owe £150,000. I would now like to sell the flat and go back to renting but I think the price of my property has fallen to around £145,000. I don't have access to any extra money to pay back the £5,000 plus anything else on top such as re-payment fees. Will my mortgage lender let me sell the flat and continue to pay the remainder of the mortgage if I go into rented accommodation? |

Unfortunately not. By definition the mortgage is secured against the property and if you have sold it you cannot retain the debt against it. It is of course possible to create a loan with your lender which is then used to pay the excess off and you then continue to repay the loan. Alternatively you can rent with your lenders permission and that might be worth it given that interest rates are falling and as the capital value of the property is falling your net yield from the property is actually rising, so it makes sense to hang in there and rent. Because of the economic times many banks and lending groups are allowing the short sale. This is something that you will need to set up with your lender. If they don't, you may have financial issues. Hope they are not foreclosure or bankruptcy. |

you probably signed a mortgage of lets just say 20 years and now if you sell the property at a loss you will have to make up the short fall as well as being penalised for closing say 18 years earlier than you agreed this along with your legal fee will come to a size-able sum , you are in a no win situation what ever you do |

The lender can't stop you selling the flat but they will pursue you for the balance owed Vigorously.
As they would if you defaulted and were repossessed and they sold it off cheap for quick sale.
You would be better selling it yourself rather than letting the 2nd option happen |

You are over simplifying things - it is not just the negative equity short fall you have to take into consideration but also legal fee's and estate agents commission on the sale so the money you would need to find would be near 10 grand than 5 plus if 150k was the going rate a year ago the current realistic price is likely to be a lot less than 145k. |

they may, or they may entertain a short sale if you agree to a personal loan for the difference. if you agree to take the obligation to make them whole, be sure to get in writing that it will not affect your credit rating. You are offering to maintain full payments and keep them from losing any money at all, so they should not ding you on your credit report. But their internal systems may not be set up to process this and it could be handled as a short sale which would harm your credit.
I applaud your willingness to pay back the difference. Not many people are thinking that way these days, and if they did we might all be a lot better off. |

No they won't, once you sell the flat you lose the thing that the mortgage was secured against i.e the flat. You could always take a credit card out and pay the difference. My advice would be to stay put if you can? And just ride the storm. |
