i contact a lawyer about this issue and did u try to get ahold of this slumm rooomate. so i go ahead and bring it to a pawn shop so that way if he want his stuff back he have to pay but get a lawyer first to cover your *** |

Why don't you just find a new place to live and let the property manager deal with it. What ever the property manager does with the stuff is their problem now. If you have to pay the rent soon, keep a record of it and when your friend comes back, take them to court if they dont reimburse you. If they ask for their stuff, it's not your problem, they never told you to keep track of their stuff. If they want to be irresponsible, that's their problem, not yours. They can't hold you accountable for it. All you did was move out because you could no longer make payments on the rent. |

Maharet is right. The items left behind are NOT yours and if you sell them/lose them then your roomate can sue you for the value of the items. I would find out the rules of how items become abandoned property before you do anything to them. In addition, you can always take your roomate to small claims court for unpaid rent. |

I think you would need a few missed rent payments before you could legally do this, since a landlord can't throw someone out for one month's rent, at least in California. It takes six months.
You need a qualified lawyer to give you advice. My thought is, that if YOU signed the rental agreement and not your roommate, he's your guest and you can kick him out when your please. But on the other hand, if money has changed hands between you, you have a kind of contract.
If he misses the payment and doesn't show I think you should put his stuff in storage and get another roommate. If he comes back, you can ask him for his rent in return for his stuff. If he doesn't pay or doesn't show for a reasonable time (ask the lawyer what that would be) THEN you can sell his stuff. In my humble, completely UNqualified opinion. |

I think the proper thing to do is to try to get ahold of him via family or friends and ask him when he will be back and tell him he owes u money for the rent and have him wire it to u and if he doesnt have the money then have his family come get his stuff out of your apartment! I dont think selling it is your right but that might not be the law get ahold of a lawyer and ask him/her. You dont want to end up sued by your ex-roommate |
