It depends on if you are both currently on the mortgage. If not, you will have to read through your promissory note to see if there is an assumability clause. Some lenders will not allow a borrower to "sign over" their mortgage terms to another borrower without doing a credit check, etc. to see if the new borrower qualifies under the current terms. This prevents people with high credit to "sign over" their mortgage to someone with terrible credit and no reserves. Now, if you are both on the mortgage, it is possible, but you should contact your servicer or lender to see what the process is to remove yourself as a debtor. Hope this helps.

if you hold a joint mortgage with him at the moment then you would do a Transfer of Title. this would remove you from the mortgage and the title deeds removing your legal attachment to this. if your not removed from the mortgage and the deeds then u are still legally liable for the monthly repayments and if he misses payments then you will be affected, if hes not on the mortgage then sell him the house.

You can BUT When I was in a situation like yours some years ago my lawyer told me not to gift it [it could come back later and bite me on the ***] but to sell to prove legality of action.
I sold it to her for a penny, all legal and above board; greatly depends on the reasons and circumstances that have led you to this position.

It depends on your states tax laws on gifts. Also, if you have a loan, you'll need to check with your bank about removal from the loan. Sometimes you can get a release of obligor from the bank which will just make your ex responsible for the payments. Or, he may have to refinance the loan in his name only. But your bank may not allow this because he doesn't make enough money alone to qualify for a loan. If that's the case, you are still legally responsible for the loan payments and if he doesn't pay, you are stuck either paying or having negative marks on your credit report, no matter what your divorce decree says. Divorce court rulings don't override banking laws.

It does you credit that you have retained so much good will towards your ex. Usually people retain bitterness and hate.

Under UK law, if you are not currently married, you can gift your house to any one, but if you die within 7 years your estate will have to pay tax on it on a sliding scale.
Selling the house to your ex for a penny ( as someone has indicated above), will not be recognised by the tax authorities. They are not fools. They will take its market value.

If you are currently married you will have to obtain the consent of your present husband as he has an interest in the house.
