Can I sue my landlord?
I believe my landlord is lying about his reason for kicking me out. He claims a family emergency and has given me 30 days notice but I found out that isn't the real reason. Can I sue him? He never provided me with a rental agreement by the way.

Unless the place is rent controlled he doesn't have to give you a reason as to why they want you to move out. Just needs to give you enough notice according to how often you pay rent weekly, bi-weekly, monthly.

Well, is he the landlord or not? You can't tell half the story in a question and get a usable answer.

But you say there is no written lease, so he only has to give you 30 days notice. That's it. No reason is needed. That's why lots of tenants like a lease.

You cant sue him fool hes the land lord he can kick you out anytime your lucky he gave you the 30 days warning IF your gonna sue him you just giving away money to the lawyers

Find out what the exact tenancy laws are where you live. At the very least he could be breaking his own rental agreement with his landlord by renting to you.

Actually, it depends on where you are. I know mine in would have to provide legitimate legal reason and that I could still fight him...

If its a sublet then it still depends on local law. I know that when I tried to kick a live in BF out the cops in Atlanta told me that if he had been living there for over 30 days I couldn't without going through legal channels....

Your are a subtenant on a month to month agreement by default.

The landlord (original tenant in this case) can give you proper written notice to terminate your tenancy without cause or reason. Generally, 30 days is the norm although some states require less notice.

The original tenant is YOUR landlord - your agreement is with him.

If you do not move per the notice, he can evict you through the courts. An eviction will make finding a decent rental in the future very hard since most landlords will not accept someone who has been evicted.

If a. Hes not even the landlord
and b. There is no contract or rental agreement and you have been living there for 30 days then no. He cannot just kick you out he would have to go the legal route to kick you out by getting a legal evitction at this point no you cannot sue him IF he was the landlord with a written contract with you it doesn't matter what his reasoning he could kick you out for saying hi to him wrong if he wanted to.. but since he is not the landlord with no contract it falls back into the same thing as the other writer said like her and her bf he needs to get a legal eviction If i were you I would let the guy know that you will not be leaving in 30 days that this is your residents and he has no contract with you to even kick you out (which he may call the cops) at that point they will proceed to tell him he can't do anything without a legal eviction and leave and the guy will prob be pissed you out smarted him and maybe try to dump your stuff out.. which at that point Then you have a case to sue him and you would win.
