You can only sue if the fungus is dangerous (never heard of any that were) and you suffered actual loss because of the fungus. You can not sue because it is there.
It is likely dri-rot, which is sort of white. He does not have to fix it, but after a few years it will become an issue as the floor will become weak. |

What caused the fungus?
Wash the bathroom with bleach water, all surfaces, using gloves and mask. Remove all papertowels, sponges immediately in trash. Run fan in bathroom and bring in other fan to thoroughly dry all surfaces. After showering, run fan to reduce moisture in bath.
Most common is mildew. Most mildew is harmless but unsightly. There is mold and fungus, but fungus isn't that common. Most mildew and mold is caused by tenants NOT by LLs. and is under their control. |

First, you would need to prove that the fungus was your landlord's fault, for example if he didn't fix a known water leak. It is generally the tenant's responsibility to clean the bathroom and the lawsuit could actually turn against you. I suggest you try some bleach water or some lysol and clean the fungus. Then, wipe the shower and walls dry after each shower.
If you did sue, and could prove that the fungus was your landlord's fault, and that it was hazardous, the only thing you would get is the right to break your lease. You would still have to pay rent for the time in which you occupy the apartment, the only thing the judge can do is grant you the legal option to move out without a lease break penalty. And that would only occur if the landlord refused to fix the problem. |

with the apartments i live in we had to look at our lease when we had a fungus on our bathroom ceiling because of the tub upstairs leaking. in our lease it says that our landlord is liable for repairs. so that is the only way you can sue him if the fungus is not dangerous but if the fungus is dangerous then defiantly you can sue him! just take a look at your lease. |

If it's a dangerous fungus, definitely. If not, look at your lease, if he is responsible for maintenance or repair of problems caused by mold or vermin, etc., then yes. |

Any growth in a bathroom is considered to be caused by poor sanitary conditions brought on by the user. Suggest you scrub the bathroom down with Tilex. |

The only way you would have good case is if it was dangerous fungus. Try to do what you can to fix it with your own money if you can afford it. But if it turns out to be dangerous, then sue him for everything he's worth. Some one in your house could have been in the hospital or dead because hes lazy and won't fix your problem. |
