Can I sue the selling agent for mental stress?
Okay, I have been trying to buy this home since the beginning of Dec. (07). I have given the selling agent 2 extentions, due to them not doing what they should on a timely manner (fixing the gas leak so I could get inspections done). They knew about a boundary survey needing to be done since the first week in Jan. and they just (yesterday 1/29) gave the company/quote information to the selling agent to choose a company to do the survey...and today - finally put in orders to do the survey.
This selling agent refuses to provide an extention addendum and tells my agent that "she" needs to do one; when it is clearly the selling agents fault that we are delayed again in closing...I have provided the first two for the selling agent and their lack of duties. I have had everything ready to close since Dec. I am going out of my mind, I have heartburn everyday (constantly) now, I cry periodically, I am depressed and just giving up.....I know why this is happening, can I sue this woman?

You can sue but prevailing will be the tough part.

How do you know its the agents fault? The seller may be slow-walking some of these things too.

If you need an extension addendum, why doesn't your agent just do it? It is a one page form. Your Realtor should be on top of this to make sure everything is getting done.

Your problems are not unique, things happen, I guess I just don't understand why you are letting it upset you so much.

The agent can only request things be done by the owner. Your beef is really with the buyer. If they do not complete the tasks agreed to withion a deadline that is given, you can walk from the deal.

Yes, you can sue for anything. I would walk away, it's a buyers market and you shouldn't have to put up with this stuff. Walk away and mark another offer -10% in a month.

it's not the agents fault - it's the homeowners fault if things aren't getting done and no you can't sue anyone - if you're so upset - walk away and look for another house

No you can not sue all you can do is request your earnest money back due to Sellers agent non performance and fiduciary duties.

The Seller's agent needs to be reported to the board of realtors as well but you as a buyer unfortunately are not in the drivers seat at this time.

You would have more grounds to stand on if you didn't allow 2 extentions. That left the gate wide open.

There is something called intentional infliction of emotional distress and negligent infliction of emotional distress. Winning such a case is never certain.

Why put yourself through this. This is a horrible market and the buyer should be in the driver's seat. You should get something from the Seller (not agent as you have no contract with them) for the extension. You should be prepared to walk away from this deal, but demand a price reduction or something as your consideration for granting an extension.

Do you have an agent? Don't you have any attorney? Why not? Aren't they working on this selling agent? Aren't they giving you any advice, help?

You as buyer can contact the seller directly and discuss your concerns. This is not always advisable, and can mess up the deal or can clear the logjam.

No...but that doesn't stop people from trying.

Your best bet is to write a complaint letter, about the agent, to the mortgage company who is employing the agent to sell the property. That is about as much as you can do.

You can sue for mental stress, but won't be able to prevail. But if these delays are caused by the selling agent and as a result has cost you additional money you can sue for the additional money it has cost you. If you can prove it was done intentionally in some cases you can claim punitive damages.

Find a good Real Estate Agent. Sign an aggrement with him or her.

check out realtor.com for houses in your area that are in your price range and the size that you want.

With the "issues" the R.E. market is going through you should not be dealing with this. It's a buyers market, I'd take my money and move to Brownwood, TX.
