You can try, but since you are not party to the lease the judge may refuse to sign the subpoena as it violates the new tenants right to privacy.
And yes, a subpoena is a court order, you need a judge to issue it, you can not issue a court order on your own. |

the landlord is allowed to charge as much as traffic will bare. His charging the new tenant a fee has nothing to do with you paying rent does it? usually once you move out the landlord can allow a few days for the new tenant to move in before charging rent. And if he got the tenant to pay a prorated amount and you paid till the end of the month, you have no claim because you could have waited until the end of the month to give it back and only given him a few hours to get it ready for the next tenant. The landlord always loses, say he has to get a city inspection and can not rent it without a city cert. the landlord loses money in other ways. weeks after you leave he realizes that you stole the dishwasher and put a non-working one in its place. too late to do anything about it now that he returned your deposit. Why are you so desparate? did the landlord make love to your wife instead of collecting rent? I think this is a matter of live with it. You will be alright in your new home. Good luck. |

No. You might get it from the landlord. But if there is a lap over in rent, that isn't against the law as far as I have ever heard. What matters is the paid through dates. |

Ironically.....you don't want to do that.....tenant has a copy....you need the original......which the landlord probably has. |

I am guessing you moved out early (per lease) and he is charging you for the remainder of the lease? Yet, you think he has found someone? Laws vary state to state, but yes, the landlord must work with "due diligence" to rent the place if a lease is broken. You are often responsible for the advertising fees. If you feel he found a tenant, you should not have to continue paying rent, and/or he should refund the rent charged to you prior to getting a new lease. Have you asked him about this? Small claims court may work, but perhaps you should simply ask him. If he is closed-lipped, start the process to take him to court, and through that process he will have to show the lease and testify that the leases did not over-lap. This is my educated guess, but it may be different depending on your situation and what state you are in. Best wishes. |

You need to be a party to a lawsuit with the landlord. But if you are, you can just demand a copy of that lease in the discovery portion of the case. He would have to provide it. |

If you asked and he refused then that is the only way you are going to get a look at it. Why not just subpoena the landlord and his copy since he is the one you are suing. |
