Usually we hear about renters being informed by the banks of the foreclosure around here. It is fairly decent of him to inform you in advance that you need to look for another place to live.
The only way you can keep the house in this situation is to buy it yourself. He can sell it to you prior to the foreclosure. It will be much harder after the foreclosure, plus you have to move out anyway.
There is no one to fight though. You are a renter and have no legal claim to the property.
If you can buy the house it is your best bet. |

If you have no written lease, you can be asked to move with thirty days advance notice, and there is nothing you can do about it but leave.
If it is foreclosed upon by a lender, you will most probably have to leave anyway, since rental agreements of any sort do not transfer to the new owner (lender) in the event of a foreclosure.
Absent a written lease, you face eviction if you refuse to leave. |

You could offer to buy it but he has a right to stop being a landlord or let the house get foreclosed. Most times you only need to be given 30 days notice to vacate. Ask if the bank will allow a short sale so you can buy it for less than he owes on it. Then you could stay in the house you are used to and it would be your house not just your home. |

Yes he can. It's his house, if he does not want to renew your tenancy then he has the right to give you 30 days written notice to move. Sounds like he's letting the house get foreclosed on which means if the bank is taking over the house then you'd have to be out before they put it up for auction anyway.
If you want to stop this and keep the house then look to purchase it from him. If he's to the point of foreclosure he might take a lower offer on it. If you cannot afford to purchase the home (interest rates are really low right now) then look for another home to rent. What doesn't make sense to me is that he's been receiving money from the rental of the house, why hasn't he been paying the mortgage???

You can check your lease agreement that you had signed with him and see what the clause says about lease termination. However, you have indicated that he is going to let it go to the bank, which could possibly mean he is behind on the mortgage payment and so the bank is going to take over the house. So either way if that is the case, you might be without a home. I would suggest start looking for somewhere else. |

If you really like the house, you should ask your landlord for his bank's information so that you can make an offer. You can probably get a good deal on it.
Banks are not in the business of buying houses. They don't want the house. They want to make money from customers having mortgages on homes. It would be worth it to at least find out what is required for you to stay. The bank will be interested in working with you if you have a job, reasonable credit, etc. Good luck! |

It sounds like your landlord is being foreclosed on. Unfortunately you will be at the mercy of the bank or the next owner unless the law in your jurisdiction prevents kicking out an existing tennant. |

There is no law in any state that forces a landlord to keep a tenant without a lease. It's his house to do with as he pleases. |

I have had plenty of problems with landlords over the years and unless you want to become a realastate advisor and lawer i have found that every county has a office that deals with tennent issues no matter how small of county i would go ask the redgister of deeds they would know what office to direct you as they fall under diffrent names at diffrent places and are effected by state and local laws. |

Honestly?
Believe it or not, he is actually doing you a favor by telling you that he is letting the house go to the bank.
It has nothing to do with you not paying rent, it's the fact that he's letting the house go back and he will no longer have the right to allow you to stay, and since a Deed in Lieu is technically a foreclosure, the lease, if any, terminates upon the foreclosure.
Try living in my state....here landlords don't tell tenants that they are losing the house, and guess how much notice you get if the landlord doesn't want to give you a head's up?
