We currently rent out a commercial property and have a tenant that has not paid rent in 4 months. Can we lock them out prior to a court date, in order to protect our property? We are concerned that they are going to try to postpone the court date in order to "buy more time" to find a new location to move to and continue to not pay us rent. (We are located in NJ). |

I am not in NJ, but I am sure you can't lock them out before you received your court order. The judge should award you enough to compensate your losses (Yah, I know, collecting is an issue). |

No, you typically can not lock out a tenant without going to court for a lawful eviction. If you do that then that may be considered a "wrongful eviction" and could be sued for damages from you. Below is a website that you may find useful. Hope it helps! |

Hi,
Tempting, isn’t it? I am not familiar with New Jersey laws, but in most evictions, you have to go through the entire eviction process before you can take possession of the property. Also, if you start the process and the tenant moves out, complete the process anyway.
I have had friends who started the eviction, the tenant moved out, they took possession and rehabbed the apartment only to have the tenant move back in (said he was on vacation even tho he had moved ALL of his stuff out) and they had to start the eviction process all over again. And, of course, the tenant trashed the place again...
You need to check with a real estate attorney in your state to see if you can lock the tenant out. I sincerely doubt it. When you evict, make sure you file for any damages too.

No most courts will require you to wait until court before take control of the property. Once the judge has decided in your favor, you can pay the court for a "writ of possession" After a few days, you can set up an eviction with the sheriffs department. HOpe this helps |

LOCK THEM OUT , that way they can get real mad ,and burn down the place , and move far , far away , to never be found again , or they can do other damages which would be a misdemeanor , so they never have to worry about extradition from their new location in another state. |

in general, the east coast gives the owners the most rights, and the West gives the tenant the most rights.
lock outs are risky. do nothing without an attorneys OK. |

You can do anything, it is your property. But you may cause ill will with the tenent and lose any chance of any back rent. Speak to them and tell them you are going to change the locks unless he plans to stay |
