If they are emancipated they should be able to because they then are living on their own. |

a 16 yr old cannot legally enter a binding contract. |

you could rent it to him...he just can't sign the lease...his parents have to or you just have no lease |

Probably with a legal emancipation of a minor he can. I'm pretty sure that without that, it's not binding for a minor to sign a lease contract. |

it is legal Emma, and you can move in with him. that is your question afterall, isn't it ? |

It is only legal if you legally emancipate yourself from your parents first. You would have to go to court and fight your parents/ prove they are not raising you correctly. |

who cares? What has legality to do with anything? Just go do it |

A couple states would allow it even without emancipation. They believe that a child has a right to enter in a contract for necessities, being clothing, food, and shelter. |

Where I live you have to be 21 to buy alcohol. Should be the same too sign a legal contract. |

I assume he can. The problem will be finding a landlord willing to take the chance. At the age of 16 any contract he signs is not binding. For example a court will never force him to pay as agreed to in contract because the contract was not legal.
So he will have to find a landlord willing to take a chance. If your friend chooses not to pay, the landlord cannot seek legal action. Landlord may require someone 18 yrs or older sign the lease on behalf of your friend. The landlord can seek legal action against an 18 yr old to perform on the lease. |
